Personvārda došanas un tā maiņas problemātika

Lai arī personvārda izvēle ir daļa no personas privātās dzīves, kuras neaizskaramība ir aizsargāta ar likumu, šī tiesība nav absolūta un pastāv vairāki nosacījumi, kas jāievēro, lai personvārds tiktu reģistrēts. Bakalaura darbā ir pētīts Latvijas tiesiskais regulējums par personvārda došanu un tā maiņu, vērtēti nosacījumi, kas jāievēro izvēloties personvārdu, pētīti personvārda došanas kritēriji un tiesu prakse, kā arī vērtēti iespējamie Latvijas normatīvo aktu grozījumi. Darbā ir pētīta arī citu valstu tiesu prakse saistībā ar personvārda došanu un tā maiņu. Bakalaura darba mērķis ir iepazīties ar Latvijas Republikā spēkā esošo regulējumu personvārda došanā un tā maiņā un izvērtēt, kādos gadījumos var tikt ierobežatas personas tiesības attiecībā uz personvārda izvēli, kā arī izvērtēt to, vai likumā noteiktie nosacījumi personvārda izvēlei reāli tiek piemēroti praksē. Darba izstrādes gaitā autore secina, ka, lai arī Latvijā ir spēkā esošs regulējums, kas nosaka, personvārda došanas nosacījumus un kritērijus, tomēr ir nepieciešami stingrāki personvārdu došanas nosacījumi, kas radīti ar mērķi aizstāvēt bērna labākās intereses. Although the choice of personal name is part of the private life of a person whose integrity is protected by law, this right is not absolute and there are a number of conditions which must be observed for the registration of the personal name. The bachelor thesis has studied the Latvian legal framework for giving a personal name and changing it, evaluated the conditions to be observed in choosing the personal name, studied the criteria for giving a personal name and the case-law, as well as evaluated possible amendments to the regulatory enactments of Latvia. The work has also examined the practice of other national courts in relation to giving and changing the name of the person. The aim of the bachelor thesis is to get acquainted with the regulation in force in the Republic of Latvia in giving and changing the personal name and to evaluate the cases in which the rights of the person regarding the selection of the personal name may be limited, as well as to assess whether the conditions specified in the law for the selection of the personal name are actually applied in practice. As a result of the bachelors’s thesis, the author concludes that although there is an existing regulation in Latvia, which determines the conditions and criteria for giving a personal name, it is necessary to strengthen the conditions for giving personal names, which have been created with a view to defending the best interests of the child.
