Krimināllietas iztiesāšana personas prombūtnē (in absentia) ir izņēmums no vispārējās kārtības, kas piemērojama likumā precīzi noteiktos gadījumos. Maģistra darba mērķis ir izpētīt krimināllietas iztiesāšanas personas prombūtnē tiesiskos priekšnoteikumus, to piemērošanas robežas un nošķirt no krimināllietas iztiesāšanas bez personas piedalīšanās. Pētījumā secināts, ka pašreizējais normatīvais regulējums par krimināllietas iztiesāšanu personas prombūtnē neatbilst mūsdienu tehnoloģisko rīku iespējām un tas būtu jāmodernizē. Papildus tiesu prakse neprecīzi nošķir piemērošanas priekšnoteikumus par krimināllietas iztiesāšanu personas prombūtnē. Izvirzīti 4 priekšlikumi Kriminālprocesa likuma pilnveidošanai. A criminal trial in the absence of a person (in absentia) is an exception to the general procedure applicable in precisely specified cases of law. The aim of the Master`s work is to examine the legal preconditions in the absence of a person in criminal proceedings, the limits of their application and to separate from the trial of a criminal case without the participation of a person. The study concludes that the current regulatory framework for the trial of a criminal case in the absence of a person does not correspond to the capabilities of a modern technological tool and should be modernised. In addition, the case law inaccurately distinguishes the preconditions for the application of criminal proceedings in the absence of a person. Four proposals have been put forward for the improvement of the Criminal Procedure Law.
