Loģika tiesību normu piemērošanā: juridiskajās metodēs un argumentācijā

Šajā darbā tiek aplūkota problēma – kādā veidā loģika ietekmē tiesību normu piemērošanu? Šīs problēmas kontekstā izvirzīts darba mērķis – saprast, kādi loģikas elementi ir juridiskajās metodēs un juridiskajā argumentācijā. Lai sasniegtu šo mērķi, autors analizē loģiku juridiskajā siloģismā un citās juridiskajās metodēs, kā arī loģikas lomu juridiskajā argumentācijā kopumā. Pētījuma rezultātā autors pilnveido juridiskā siloģisma struktūru, lai ar to varētu nonākt pie konkretizētām tiesiskajām sekām, pamato, ka demokrātiskas tiesiskas valsts pamatnorma determinē vienīgi tiesiskās sistēmas ietvaru, piedāvā teleoloģiskās korekcijas metodi kā sintēzi no visām tām tiesību tālākveidošanas metodēm, kurās tiesību normas tvērums tiek izmainīts, balstoties uz ratio legis. In this work, the examined problem is – in what ways does logic affect the application of legal norms? In the problem's context, the following aim is brought forward – to understand what elements of logic are there in legal methods and legal argumentation. To achieve this aim, the author analyses the logic of the legal syllogism and other legal methods as well as the role of logic in legal argumentation in general. In the results of the study, the author improves the structure of the legal syllogism so that it can be used to get specified legal consequences, demonstrates that the basic norm of a democratic state based on the Rule of law determines only the frame of the legal arrangement, offers the method of teleological correction as a synthesis between all the legal methods of further development of law in which the scope of the legal norm is corrected based on ratio legis.
