Abstract
Bērna izcelšanās no tēva noteikšana un apstrīdēšana personām rada tiesības un pienākumus, tā ietekmē gan mantiskās, gan personiskās tiesības, tādēļ būtiski, lai regulējums būtu skaidrs un taisnīgs. Maģistra darba mērķis ir, izpētot bērna izcelšanās no tēva noteikšanas un apstrīdēšanas tiesisko regulējumu un praktiskos aspektus, identificēt būtiskākās nepilnības un ieteikt to risinājumu. Tā, piemēram, darbā analizēta problemātika, kas saistīta ar trīspusējās paternitātes atzīšanas iesniegumu un tā iesniegšanas laiku, kā arī apskatītas bērna tiesības uz paternitātes apstrīdēšanu, norādīts uz materiālo un procesuālo tiesību normu nesakritību u.c. būtiski aspekti, kuriem būtu nepieciešams pievērst uzmanību. Maģistra darba izstrādes rezultātā secināts, ka bērna izcelšanās no tēva noteikšanas un apstrīdēšanas regulējumā joprojām pastāv nepilnības, un autore ieteikusi to risinājumus.
Determining and contesting the child’s descent from a father creates rights and obligations for individuals, it affects both property and personal rights, therefore it is very important that the regulation is clear and fair. The aim of the Master’s Thesis is to study the legal regulation and practical aspects of determining and contesting the child’s descent from his father and to identify the key issues and recommend the solutions. For example, the Master Thesis includes the issues related to the tripartite recognition of paternity and the time of its submission, also Master Thesis includes the child’s right to contest paternity, also author points to the discrepancy between substantive and procedural law etc. important aspects that need to be viewed. As a result of the Master’s Thesis, it has been concluded that there are still shortcomings in the regulation of determining and contesting the child’s descent from the father, and the author has suggested solutions.
