Attaisnojošs spriedums nereti sabiedrības acīs tiek uztverts kā valsts nespēja notiesāt noziedzniekus, raidot pārmetumus tiesībsargājošo iestāžu virzienā. Taču tiesiskā valstī līdz kriminālprocesa rezultātam ir nepieciešams nonākt tiesiskā ceļā, korekti pierādot personas vainu. Tādēļ, ja personas vaina noziedzīga nodarījuma izdarīšanā pierādīta netiek, ir taisāms attaisnojošs spriedums. Darbā tiek pētīts attaisnojoša sprieduma regulējums Kriminālprocesa likumā un tā piemērošana praksē, tostarp analizējot attaisnojoša sprieduma struktūras un formas noteikumus, nevainīguma prezumpcijas un pierādījumu novērtēšanas nozīmi, kā arī attaisnojoša sprieduma pārskatīšanas iespējas. Īpaša uzmanība darbā tiek pievērsta Kriminālprocesa 519.pantā reglamentētajiem attaisnojoša sprieduma taisīšanas pamatiem, sniedzot priekšlikumus par normas iespējamiem uzlabojumiem. Judgment of acquittal is often perceived by the public as the state’s inability to convict criminals, causing rebukes towards law enforcement authorities. However, in a state of rule of law it is necessary to come to the results of a criminal proceeding in a legal path, correctly proving a person’s guilt. Therefore, if the person's fault in committing a criminal offence is not proven, a court shall render a judgment of acquittal. This work examines the regulation of a judgment of acquittal in the Criminal Procedure Law and its application in practice, including analysis of the structure and form of a judgment of acquittal, the importance of the presumption of innocence and the assessment of evidence, as well as the possibilities for reviewing a judgment of acquittal. Particular attention is paid to the grounds for the rendering of a judgment of acquittal as regulated under Article 519 of the Criminal Procedure Law by providing proposals for possible improvements.
