Noziedzīgi iegūta mantas jēdziens ir ilgstoši veidojies, noziedzīgi iegūtas mantas pierādīšana saistībā ar pierādīšanas standarta pazemināšu un pierādīšanas pienākuma “pārnesi” ir kļuvusi īpaša aktuāla. Ievērojot pēdējā laika aktualitāti saistībā ar noziedzīgi iegūtu mantas pierādīšanu un veiktos grozījumos normatīvajos tiesību aktos, kas ir raisījuši pretrunīgus viedokļus, darbs ir vērts uz noziedzīgi iegūtas mantas pierādīšanas īpatnību izpēti un analīzi. Darbā izklāstīta noziedzīgi iegūtas mantas izpratne, sniegts izvērtējums un piedāvāti priekšlikumi izmaiņām normatīvajā regulējumā attiecībā uz noziedzīgi iegūtas mantas pierādīšanas standartu un pienākumu. Darba secinājumi ir apkopoti kopsavilkumā ar mērķi akcentēt tiesiskās vides problēmjautājumus noziedzīgi iegūtas mantas pierādīšanas jomā, tos risināt, veicot izmaiņas tiesiskajā regulējumā, stiprināt Latvijas regulējuma atbilstību starptautiskajām prasībām un ieteikumiem. The concept of criminally acquired property has developed for a long time, proving of criminally acquired property in the context with the lower standard of proof and shift of burden of proof has become especially relevant. Considering the recent topicality of proving of criminally acquired property and amendments to the regulatory enactments, which have caused contradictory views, this master’s thesis is focused on the research and analysis of specific characteristics of proving of criminally acquired property. This thesis sets out the understanding of criminally acquired property, provides an assessment and offers solutions regarding the standard and burden of proof of criminally acquired property. Conclusions of this thesis are compiled in a summary with purpose to emphasize the problems in the legal environment regarding the proving of criminally acquired property, to solve the identified problems by amending the legal enactments and to strengthen the compatibility of Latvia’s regulations with the international requirements and recommendations.
