Bērna tiesības zināt savu izcelsmi ir samērā jauns institūts, kurš starptautiskajā mērogā tiek daudz un dažkārt pretrunīgi vērtēts. Eiropas Cilvēktiesību tiesas un Latvijas tiesu prakse parāda, ka ne vienmēr ir skaidrs, kādā veidā bērnam ir jānodrošina viņa tiesības zināt savu izcelšanos un kā ir risināmas sadursmes starp kolidējošām tiesībām un citu personu interesēm, taču kopumā tiesību zināt savu izcelšanos izpratne laika gaitā ir attīstījusies un mainījusies. Vienlaikus neskaidrs paliek jautājums, vai Latvijas nacionālais normatīvais regulējums ir šai izpratnei atbilstošs? Maģistra darbā ir apskatīta bērnu tiesību zināt savu izcelšanos vēsturiskā attīstība, saturs, tostarp šo tiesību negatīvā izpausme – tiesības nezināt savu izcelšanos –, un apjoms, apzināti aktuālie problēmjautājumi un tiesību kolīzijas, izvērtēts normatīvais regulējums un starptautiskā un nacionālā tiesu prakse, kā arī sniegti iespējamie priekšlikumi, kas sekmētu bērnu tiesību zināt savu izcelšanos ievērošanu. The right for a child to know its origin is a relatively new human rights institute which is often judged on an international scale and sometimes even in contradictory ways. The case study of the European Court of Human Rights and the Latvian Courts shows that there is not always a clear procedure on how to guarantee a child its right to know his or her origins and how to resolve clashes between corollary rights and the interests of others. Also, it is needed to know that the understanding of the right for a child to know his or her origins has evolved and changed over time. At the same time, it remains unclear whether Latvia's national regulatory framework is consistent with this understanding? The Master's work deals with the historical development of the rights of children to know their origins, the content, including the negative expression of their rights – the right not to know their origins – and the scope, the identified challenges and conflicts of law, the regulatory framework and international and national judicial practices, and the possible proposals to promote the right of children to know their origins respect for arrivals.
