Maģistra darba tēma ir “Vispārzināmie fakti kriminālprocesā: būtība un problemātika”, savukārt darba mērķis ir izpētīt normatīvo regulējumu, doktrīnu un judikatūru Latvijā un ārvalstīs. Zinot, ka fakta legālā prezumpcija sniedz atkāpi no kriminālprocesa pierādīšanas pienākuma, darbā pirmajā pusē ir apskatīti jautājumi par pierādīšanu, pierādījumiem, prezumpcijām un darba otrā pusē arī par vispārzināmiem faktiem. Darba ietvaros autors vēlas padziļināti noskaidrot iepriekš minēto jēdzienu saistību un nozīmi kriminālprocesā. Lai sasniegtu izvirzīto mērķi, autors par galvenajiem uzdevumiem uzskatīja veikt pierādījumu, pierādīšanas un pierādīšanas standarta būtības izpēti, kriminālprocesa paredzēto prezumpciju pastāvēšanas izpēti un vispārzināmu faktu satura noskaidrošanu. The theme of the Master’s thesis is “Generally known facts in criminal procedure: nature and problems”, the main goal of the Master’s thesis is to explore the regulatory framework, doctrine and case law in Latvia and in foreign states. Keeping in mind that fact legal presumption gives a deragation from burden of proof in criminal procedure, first half of this thesis includes subjects as evidence, proving, presumptions and the second half consists of subject - generally known facts. In the context of this work, the author wishes to clarify in depth the realtionship and importance of the above mentioned subjects in criminal proceedings. In order to reach the main goal, the author considered the main tasks are to carry out research about evidence, proving and burden of proof, the existence of the presumptions in criminal proceedings and get to know the content of generally known facts.
