Tiesiskās noteiktības princips ir vispārējais tiesību princips, kas nepamatoti tiek pieminēts daudz retāk nekā tiesiskās drošības vai tiesiskās paļāvības princips. Krimināltiesiskajās attiecībās tam ir sevišķa nozīme, jo tieši krimināltiesiskās sekas var ietekmēt gan personas brīvību, gan īpašumu, tāpēc tiesiskās noteiktības princips prasa ievērot noteiktas prasības gan likumdevējam, gan tiesību normu piemērotājam. Darbs ir vērsts uz tiesiskās noteiktības principa satura un nozīmes noteikšanu tieši kriminālprocesā, neapskatot tā tiešo ietekmi no materiālo tiesību skatu punkta, kur pamatā darbojas princips nullum crimen nulla poena sine lege. Darbā vispārīgi ir apskatīta tiesiskās noteiktības principa teorētiskā izpratne, veikta principa mijiedarbības ar citiem principiem izpēte un apskatīti kriminālprocesā ietvertie institūti, kuros tiesiskās noteiktības principam ir sevišķa nozīme. Rezultāti ir apkopoti tēžu veidā, kas palīdzēs izprast šī principa saturu, nozīmi un pārkāpšanas sekas kriminālprocesa ietvaros. Principle of legal certainty is a general principle of law that undeservedly is mentioned much less often than the principle of legal safety or legitimate expectations. In criminal proceedings it has special significance because the result can often be the deprivation of freedom or property, therefore the principle of legal certainty has certain requirements for both the lawmaker and law enforcer. This Master’s thesis aims to determine the nature and substance of the principle of legal certainty in criminal procedure, while ignoring it’s effects in substantive criminal law where it is generally accepted that the principle nullum crimen nulla poena sine lege takes effect. It consists of general analysis of the principle of legal certainty, it’s relations with other principles of law and the outline and analysis of certain parts of criminal procedure in which this principle has the most effect. The results are summarized in form of theses, which should help to determine the substance, meaning and the effects of legal certainty in criminal procedure.
