Maģistra darbā “Negatīvās atzīšanas prasības teorētiskie un praktiskie aspekti civilprocesā” ir pētīts negatīvas atzīšanas prasības institūta vēsturiska attīstība no Senas Romas laikiem līdz mūsdienam, tiek analizētas negatīvas atzīšanas prasības pieļaujoši priekšnoteikumi, ir apskatīta Civilprocesa likuma 1. panta 1. daļas kopsakarā ar personu pamattiesībām ar mērķi noteikt kādos gadījumos persona var vērsties tiesā ar negatīvas atzīšanas prasības pieteikumu. Darba ietvaros tiek pētīta nacionāla tiesu prakse par personu subjektīvajām tiesībām vērsties tiesā ar negatīvas atzīšanas prasības pieteikumu, kā arī ārvalstu un Eiropas Savienības Tiesas prakse saistība ar negatīvas atzīšanas prasības interpretāciju. Autore analīzē normatīvo aktu interpretācijas un piemērošanas problēmas, identificē to cēloņus un piedāvā savu risinājumi. The Master's thesis “theoretical and practical aspects of the Negative Recognition Requirements in civil proceedings” studies the historical development of the Institute for Negative Recognition Requirements from the Ancient Rome to the present, analyzing the preconditions for negative recognition requirements, examined Section 1(1) of the Civil Procedure Law in conjunction with the fundamental rights of individuals with a view to determining the individuals in which cases a court may be seized with an application for negative recognition. As part of the work, the national case-law on the subjective right of individuals to apply for negative recognition, as well as the case-law of the foreign and European Court of Justice in relation to the interpretation of a negative recognition claim, are examined. The author analyzes the problems of interpretation and application of regulatory acts, identifies their causes and offers her solutions.
