Kriminālprocesā pastāv līdztiesības princips, kas liedz kādu nostādīt labvēlīgākā pozīcijā iepretim citiem subjektiem, toties sakarā ar 19.11.2020. Grozījumiem Kriminālprocesa likumā rodas jautājums, vai un kā līdztiesības princips „iedzīvināts” ne tikai iztiesāšanā, bet arī pirmstiesas kriminālprocesā. Kā pētījuma mērķi autors norāda kriminālprocesuālo pierādīšanas subjektu tiesiskā regulējuma un tā kopsakara ar līdztiesības principa izpēti. Mērķa sasniegšanai autors izpētīs pierādīšanas subjektu tiesisko regulējumu, veiks līdztiesības principa izpausmju analīzi un aplūkos minētos Kriminālprocesa likuma grozījumus, lai izdarītu secinājumus par to atbilstību vai neatbilstību līdztiesības principam. Pētījuma rezultātā autors secina, ka pirmstiesas kriminālprocesā līdztiesības princips funkcionē atbilstoši attiecīgās stadijas specifikai, kā arī 19.11.2020. Grozījumi Kriminālprocesa likumā rada līdztiesības principa pārkāpumu. There is the principle of equality of arms in criminal proceedings, which prevents someone from being placed in a more favorable position vis-à-vis other subjects, but the 19.11.2020. Amendments to the Criminal Procedure Law raise the question whether and how the principle of equality is “implemented” not only in court proceedings, but also in pre-trial criminal proceedings. The author points out the research of the legal regulation of the subjects of criminal procedural evidence and its connection with the principle of equality as the goal of the research. To achieve the goal, the author will study the legal regulation of evidence subjects, analyze the manifestations of the principle of equality of arms and study the above-mentioned amendments to the Criminal Procedure Law in order to draw conclusions about their compliance or non-compliance with the principle of equality of arms. As a result of the research, the author concludes that in the pre-trial criminal proceedings the principle of equality of arms functions in accordance with the specifics of the respective stage, as well as 19.11.2020. Amendments to the Criminal Procedure Law violate the principle of equality of arms.
