Preču zīmju sajaucamā līdzība.

Abstract

Pasaulē pieaugot reģistrēto preču zīmju skaitam, pieaug arī vajadzība pēc izpratnes par preču zīmju sajaucamo līdzību. Praksē var novērot, ka cilvēkiem trūkst pieredzes un informācijas par to, kā izveidot spēcīgu preču zīmi, un izpratne par to kas ir sajaucami līdzīgas zīmes. Līdz ar to, ir novērojami daudz strīdu starp sajaucami līdzīgām preču zīmēm. Lai veicinātu preču zīmju īpašnieku informētību un mazinātu nevajadzīgus strīdu rašanos nākotnē šī darba ietvaros tika apkopoti kritēriji pārskatāmā veidā. Šie kritēriji kalpo gan kā palīgmateriāls preču zīmju īpašniekiem, lai aizsargātu savas tiesības, gan palīgs profesionāliem patentpilnvarniekiem, veicot agrāko tiesību meklējumu rezultātu analīzi. Veicot šo pētījumu autore secināja, ka pamatā sistēma ir sakārtota, bet ir daži ieteikumi, kuri varētu mazināt strīdu rašanos nākotnē. Autore uzskata, ka agrāko tiesību pārbaudei ir jābūt obligātai pirms preču zīmes reģistrācijas un tas ir jāveic Patentu valdei. Ja pārbaudes gaitā tiktu konstatētas, ka preču zīmei ir augsta sajaucamās līdzības pakāpe ar citu personu agrākām tiesībām, tad reģistrācija būtu jāatsaka. Tādā veidā preču zīmju īpašnieki tiktu informēti par iespējamiem riskiem nākotnē, kā arī tiktu mazināta tādu preču zīmju reģistrācija, kura, iespējams, ir ar negodprātīgu nolūku. Ņemot vērā to, ka vērtēšanas kritēriji ir salīdzinoši daudz un tas, kurš kritērijs prevalē ir atkarīgs no konkrētās situācijas, tādēļ, lai atvieglotu pašu vērtēšanas procesu, autore piedāvā izstrādāt lietotni, ar kuras palīdzību (ievadot preču zīmes) tiktu prognozēta to sajaucamās līdzības pakāpe. Taču tā kā šādas programmas izveidošana, uzturēšana būtu salīdzinoši dārga un laikietilpīga kā arī tas cik precīzi būtu iegūtie rezultāti vēl ir nākotnē pētāms jautājums.

As the number of registered trademarks increases - so does the need of understanding the likelihood of confusion increases. In practice it is observed, that people don`t have enough knowledge and experience on how to create a powerful trademark and there is a lack of understanding about what confusingly similar marks are. Consequently, there are many disputes about confusingly similar marks. In order to raise awareness among trademark owners and reduce the number of unnecessary disputes in the future, the criteria have been compiled in a transparent way. These criteria serve both - as a guide for trademark owners to protect their rights and as a tool for professional patent attorneys to help them analyze the gained earlier rights results. The author concluded, that the system is functional, but there are some recommendations that could reduce the occurrence of disputes in the future. One of the recommendations is that the examination of earlier rights should be mandatory before the registration of a trademark and should be carried out by the Patent Office of Latvia. The registration should be refused, if during the examination, the marks are found to have a high degree of confusion with other earlier rights. This way, trademark owners are informed of the potential risks in the future and it also reduces the number of trademarks, that have been registered in bad faith. Taking into account that, the number of evaluation criteria is relatively large, the author suggests to develop software that would evaluate the degree of similarity between trademarks. However, the development and maintenance of such software would be relatively expensive and time consuming as well as the accuracy of the results obtained would require research in on itself.
