Bakalaura darba tēma ir “Juridisko faktu konstatēšanas īpatnības sevišķajā tiesāšanas kārtībā”. Juridisko faktu konstatēšana ir viena no lietu kategorijām, kas tiek izskatīta sevišķās tiesāšanas kārtībā. Bakalaura darbā tiks salīdzināti šādi tiesvedības veidi - prasības tiesvedība un sevišķās tiesāšanas kārtība, lai varētu tikt konstatētas būtiskākās iezīmes, kas nošķir abus tiesvedības veidus. Tiks apskatīta arī tiesu prakse par juridisko faktu konstatēšanu. Darba mērķis ir konstatēt atšķirības šajos tiesvedības procesos – prasības tiesvedībā un sevišķajā tiesāšanas kārtībā, izprast juridiska fakta nozīmi un aplūkot juridisko faktu daudzveidību. Bakalaura darba izpētes rezultātā tiks apkopoti darbā gūtie secinājumi, kā arī piedāvāti priekšlikumi Civilprocesa likuma 37. nodaļas uzlabošanai. The theme of the Bachelors thesis is “Peculiarities in the legal matters in the special court proceedings”. The establishment of legal matters is one of the categories which are reviewed in the special court proceedings. In the Bachelors thesis will be compared the following types of proceedings - court proceedings by way of action and special court proceedings, so that differences can be identified between these two proceedings. Also will be viewed the case law of establishment of legal matters. The aim of the Bachelors thesis is to establish the differences in these proceedings – court proceedings by way of action and special court proceedings, understand the meaning of the legal matters and view diversity of the legal matters. As a result of the research of the Bachelors thesis will be compiled the conclusions and will be offered proposal for the improvement of Civil Procedure Law Chapter 37.
