Abstract

Maģistra darba temats ir “Problemātiskie aspekti Latvijas valsts civildienestā, kas saistīti ar ierēdņa iecelšanu amatā un valsts civildienesta gaitu”. Maģistra darba mērķis ir padziļināti izpētīt valsts civildienesta regulējumu no Latvijas valsts dibināšanas 1918.gadā līdz mūsdienām, lai identificētu problēmas, kuras rada likuma normas, kas nosaka ierēdņa iecelšanu amatā, ierēdņa tiesības un pienākumus, ierēdņa valsts civildienesta gaitu un atbrīvošanu no amata. Darbā izmantota autores pieredze, strādājot valsts civildienestā un vērojot valsts civildienesta regulējošo tiesību normu ietekmi uz ierēdņiem un valsts civildienestu kopumā. Darba kopsavilkumā autore secina, ka atsevišķas normas vajadzētu pilnveidot, būtu nepieciešams izveidot mehānismu iestāžu iekšējo lēmumu kontrolei, kā arī izveidot neatkarīgu Ētikas komisiju, kas sniedz vērtējumu par dažādi traktējamām situācijām no ētikas viedokļa, kā arī kontrolētu ētikas principu ieviešanu Latvijas valsts civildienestā. Maģistra darbā izmantotie avoti ir periodika, normatīvie akti, Latvijas un Eiropas Savienības tiesu prakse, politikas plānošanas dokumenti, informatīvi materiāli. The topic of the master's thesis is "Problematic Aspects of the Latvian State Civil Service regarding appointments to the Civil service positions and a course of State Civil service careers". The aim of the master's thesis is to study the regulation of the civil service from the foundation of the Latvian state in 1918 to the present day in order to identify the problems caused by the provisions of the law that determine the appointment of a civil servant, the rights and duties of a civil servant, the course of service of a civil servant and the dismissal from the post of civil servant. The work uses the author's experience of working in the civil service and observing the impact of civil service legislation on civil servants and the civil service. The author concludes in the summary of the work that some norms should be improved, it would be necessary to create a mechanism for control of internal decisions of institutions, as well as to create an independent Ethics Commission, which would provide an assessment of different situations from the point of view of ethics and would control the implementation of ethical principles in the Latvian State Civil Service.
