Lai persona īstenotu savas Satversmē noteiktās tiesības - paturēt un izplatīt informāciju, tai vispirms informācija ir jāsaņem. Kārtību, kā tas notiek, nosaka Informācijas atklātības likums. Tajā minētās tiesību normas ir viens no veidiem, kā panākt, lai valsts pārvalde būtu atklāta un darbotos sabiedrības interesēs. Šī darba ietvaros ir pētīts, vai Informācijas atklātības likumā noteiktais subjektu loks ir pietiekams šādu interešu un valsts pārvaldes darbības caurskatāmības nodrošināšanai. Analizējot likumus, to anotācijas, pieņemšanas gaitu Saeimā, tiesu praksi, juridisko literatūru, ārvalstu pieredzi un veicot apjomīgu praktisko pētījumu, darba rezultātā ir secināts, ka būtu jāpaplašina Informācijas atklātības likumā noteikto subjektu tvērums. Tāpat ir identificētas nozīmīgākās problēmas, kas kavē Satversmē noteikto tiesību īstenošanu. In order for a person to exercise his or her rights under the Constitution of the Republic of Latvia (Satversme) - to retain and disseminate information, he or she must first acquire the information. The procedure for acquiring information is determined by the Freedom of Information Law. The legal provisions laid out in it are one of the ways to ensure that public administration is transparent and acts in the public interest. This work examines whether the range of legal subjects specified in the Freedom of Information Law is sufficient to ensure that such public interests and transparency of public administration activities are achieved. By analyzing the laws, their annotations, the passing process through the Parliament of the Republic of Latvia, the court practice, legal literature, foreign experience and through extensive practical research, this work concludes that the scope of the legal subjects specified in the Freedom of Information Law shall be expanded. This work also identifies the most significant obstacles that hinder the implementation of the rights established in the Constitution of the Republic of Latvia.
