Maģistra darba tēma ir “Iekļaujoša nodarbinātības politika (pozitīvie pasākumi) organizāciju vadībā”. Maģistra darba pētījuma primārais mērķis ir izvērtēt vienlīdzīgu iespēju nodrošināšanu nodarbinātībā Eiropas Savienības politikas un tiesību pasākumos, kā arī analizēt to ieviešanu Eiropas Savienības un Latvijas līmenī. Maģistra darbā diskriminācijas jautājums nodarbinātībā tiek skatīts plašākā tvērumā, analizējot ne tikai diskriminācijas aizlieguma principu, bet arī nodrošinot vienlīdzīgu attieksmi un vienlīdzīgas iespējas Eiropas Savienības un nacionālajā politikas plānošanā, Eiropas Savienības tiesībās un nacionālajās tiesību sistēmās. Īpaša uzmanība tiek pievērsta EST judikatūrai pozitīvo pasākumu jomā nodarbinātībā un tās ietekmei uz Eiropas Savienības un dalībvalstu tālākām rīcībām. Darba ietvaros tiek analizēta terminoloģija un tās nozīme tiesību interpretācijā. Atsevišķa sadaļa tiek veltīta Latvijas Republikas politikas plānošanas dokumentu un tiesiskā regulējumu pozitīvo pasākumu ieviešanai nodarbinātības jomā vērtējumam. Secinot, ka pozitīvie pasākumi nodarbinātībā Latvijā gandrīz neeksistē, tie lielākoties ir neregulāri, nav sistēmiskas attīstības ne politikas plānošanā, ne normatīvajā regulējumā, tiek sniegti ierosinājumi šīs normas pilnveidei gan politikas plānošanas, gan tiesiskā regulējuma jomā. The topic of the master's thesis is "Inclusive employment policy (positive actions) in the management of organizations". The primary goal of the Master's thesis research is to evaluate the provision of equal opportunities in employment in the European Union policy and legal measures, as well as to analyze their implementation at the European Union and Latvian level. In the Master's thesis, the issue of discrimination in employment is considered in a broader context, analyzing not only the principle of non-discrimination, but also ensuring equal treatment and equal opportunities in European Union and national policy planning, European Union law and national legal systems. Particular attention is paid to the case law of the CJEU on positive action measures in employment and its implications for further action by the European Union and Member States. The work analyzes the terminology and its role in the interpretation of law. A separate section is devoted to the evaluation of the implementation of positive measures in the field of employment in the policy planning documents and legal framework of the Republic of Latvia. Concluding that positive actions in employment in Latvia are almost non-existent, they are mostly irregular, there is no systemic development in policy planning or regulatory framework, suggestions are made for the improvement of this norm in the field of policy planning and legal regulation.
