Abstract
Maģistra darba mērķis ir apzināt un izpētīt iespējamos prasības nodrošināšanas instrumentus Eiropas Savienībā, kas ir piemērojami pārrobežu strīdiem civillietās un komerclietās, salīdzināt tos savā starpā, kā arī identificēt un apkopot ar šo instrumentu piemērošanu saistītās problēmas, īpašu uzmanību veltot šo instrumentu piemērošanai Latvijā. Maģistra darbā ir apskatīti tādi pārrobežu prasības nodrošināšanas instrumenti kā pagaidu, tostarp aizsardzības, pasākumi, kas paredzēti Briseles I bis regulā, un Eiropas kontu apķīlāšanas rīkojums. Pētījuma rezultātā secināts, ka, neskatoties uz likumdevēja pastāvīgu darbu pie pārrobežu prasības nodrošināšanas institūta uzlabošanas un ievērojamu progresu šajā jomā, praksē joprojām pastāv atsevišķas ar minēto instrumentu piemērošanu saistītas problēmas, kā arī tiek apšaubīta minēto instrumentu pieejamība ikvienam kreditoram.
The aim of the Master's thesis is to identify and explore possible judicial instruments that provide provisional and protective measures in cross-border disputes in the European Union, compare them with each other, and identify and summarize the problems associated with the application of these instruments, paying particular attention to the application of these instruments in Latvia. The Master's thesis deals with judicial instruments such as provisional, including protective, measures provided for in the Recast Brussels Regulation and the European Account Preservation Order. Author concludes that, despite the continued work of the legislator on improving provisional and protective measures in cross-border disputes and significant progress in this area, there are still some problems related to the application of these judicial instruments in practice and the availability of these instruments to all creditors is questioned.
