Kriminālprocesi par noziedzīgiem nodarījumiem, kas pēc sava rakstura ir vērsti uz materiāla vai citāda labuma gūšanu, notiek visbiežāk, kā arī lielos daudzums tiek konfiscēta noziedzīgi iegūtā manta, taču reti notiek vainīgo personu saukšana pie kriminālatbildības par šo noziedzīgi iegūto līdzekļu legalizēšanu. Maģistra darba mērķis ir rast atbildes uz juridiskajiem šķēršļiem, kas pastāv kriminālprocesos un traucē pierādīt personas vainu noziedzīgi iegūtu līdzekļu legalizēšanā, līdz ar to darbā veicamie uzdevumi ir izpētīt Kriminālprocesa likuma 9.nodaļas regulējuma atbilstību saistošajām starptautisko tiesību nostādnēm, tā tiesiskumu un pielietojumu praksē procesos par noziedzīgi iegūtu līdzekļu legalizēšanu, kā arī izpētīt vai samazinātais pierādīšanas standarts ir attiecināms arī uz kādu no legalizācijas noziedzīgā nodarījuma sastāva pazīmēm. Maģistra darba rezultātā tiek piedāvāti gan ierosinājumi iespējamiem likuma grozījumiem, gan ieteiktas vadlīnijas turpmākām vienveidīgas prakses izpratnes attīstības iespējām efektīva noziedzīgi iegūtu līdzekļu legalizācijas pierādīšanas procesa nodrošināšanai Latvijā. Criminal proceedings for criminal offenses, which by the nature are aimed at obtaining material benefits or benefits of other kind, are the most common, as well as large-scale confiscation of criminally obtained property can be observed, however the perpetrators are rarely prosecuted for money laundering in the process. The aim of the present Master thesis is to find answers to legal obstacles that exist in criminal proceedings and interfere in the process of declaring a person guilty in money laundering, thus the tasks to be fulfilled in the present paper are to investigate the compliance of the regulation of Chapter 9 of the Criminal Procedure Law with binding norms of international law, its rule of law and application in the practice of money laundering proceedings, as well as to investigate whether the reduced standard of proof is also applicable to any of the features of the criminal offense of money laundering. As a result of the analysis carried out in the present Master thesis, suggestions for possible amendments to the law are offered, as well as guidelines for further development of a uniform understanding of practice to ensure effective money laundering proof process in Latvia are suggested.
