Bakalaura darba tēma ir “Kriptovalūta kā noziedzīgā nodarījuma priekšmets”. Arvien vairāk cilvēku un valstu sāk izmantot virtuālo valūtu ikdienas norēķinos un ieguldījumos. Ņemot vērā to, ka kriptovalūta kā finanšu instrumenta veids nav jaunums, pasaules valstīs vēljoprojām ir diezgan neskaidrs vai nepietiekams normatīvais regulējums un izpratne par virtuālo valūtu. Kriptovalūtas decentralizācija un anonimitāte ir svarīgākās pazīmes, kas rada labvēlīgu vidi, lai tā tiktu izmantota noziedzīgos nodarījumos. ES un pārējās pasaules valstīs likumdevēji aktīvi cenšas regulēt kriptovalūtu un ar to saistītos jēdzienus. Straujā kriptovalūta attīstība finanšu sektorā un citās jomās neļauj pietiekoši ātri likumdevējiem visā pasaulē reaģēt un veikt atbilstošas izmaiņas likumos, lai pareizāk un efektīvāk varētu interpretēt likuma normas noziegumos, kuros ir iesaistīta kriptovalūta. Veiktais pētījums ļāva autoram secināt, ka LR normatīvie akti ļauj veikt piemērošanu noziedzīgos nodarījumos ar kriptovalūtu, taču ir nepieciešami grozījumi atsevišķos likumos, lai regulējums atbilstu pilnībā kriptovalūtas ienākšanai tiesu praksē. The use of cryptocurrency has rapidly expanded as more people and countries are beginning to use and adapt crypto in their daily investments and transactions. Given that cryptocurrency is new subject and one of the financial instruments, there is still considerable uncertainty and insufficient regulations worldwide. Decentralization and anonymity are the main features that creates favorable environment for cryptocurrency to be used as a tool in criminal activities Legislators in the EU and the rest of the world are trying to regulate cryptocurrency and related concepts. The rapid development of the cryptocurrency in the financial sector and elsewhere does not allow legislators around the world to react quickly enough and make appropriate changes to the law to better and more effectively interpret the law in crimes involving the cryptocurrency The study allowed the author to conclude that the regulatory enactments of the Republic of Latvia allow for application in criminal offenses with cryptocurrency, but amendments to certain laws are needed to ensure that the regulation fully complies with the entry of cryptocurrency into court practice.
