Zemesgrāmatu ieraksta publiskās ticamības princips ir nozīmīgs instruments, kas nodrošina paļāvību personām, ka zemesgrāmatās veiktie ieraksti atbilst patiesajam tiesiskajam stāvoklim. Kā viens no šī principa pamatmērķiem ir labticīgā nekustamā īpašuma ieguvēja aizsardzība. Tomēr pašlaik spēkā esošais tiesiskais regulējums Latvijā neparedz šī principa efektīvu funkcionēšanu praksē. Bakalaura darba ietvaros tiek izvērtēti problemātiskie tiesiskie aspekti Latvijā, kas neļauj zemesgrāmatu ieraksta publiskās ticamības principam efektīvi funkcionēt, lai nodrošinātu civiltiesiskās aprites stabilitāti nekustamo īpašumu atsavināšanas darījumu jomā. Darbā arī tiek izvērtēts Vācijas tiesiskais regulējums kontekstā ar Latvijas tiesību normām saistībā ar šī principa piemērošanas aspektiem, ņemot vērā, ka Vācijā šis princips funkcionē ievērojami labāk. Pamatojoties uz konstatētajiem problēmjautājumiem un Vācijas praksi, darbā tiek piedāvāti ierosinājumi Latvijas tiesiskā regulējuma pilnveidošanai. The presumption of the accuracy of the contents of the land register is an important tool that guarantees the belief for individuals that entries in the land register meet the true legal state of the real property. One of the main purposes of this presumption is to establish legal protection for the individuals, who acquire property rights in good faith. Though the current law in Latvia does not provide an effective application of this presumption in practice. Within the bachelor thesis, the author evaluates problematic legal aspects within the Latvian law, that do not allow the previously mentioned presumption to function properly to ensure that the circulation of real property rights happens in a predictable manner. Bachelors theses also include an assessment of how the same legal presumption functions in Germany since it is known that there it functions far more effectively than it does in Latvia. Based on the conclusions of the disadvantages of applying this legal presumption in Latvia, in relation to the German experience applying this presumption, a few solutions are proposed to better the Latvian law.
