Laulību līgumi

Abstract

Bakalaura darba tēma ir “Laulību līgumi”. Šajā darbā autore pētīja laulāto līgumisko mantisko attiecību attīstību Latvijā un mūsdienu regulējumu, lai izprastu, kāpēc ir nepieciešami laulību līgumi, kāpēc tos neslēdz katrs vai katrs otrs laulātais pāris. Darbā aplūkots arī citu valstu laulāto mantisko attiecību regulējums, lai novērtētu līdzības un atšķirības ar Latvijas līgumisko laulāto mantisko attiecību regulējumu. Latvijas laulāto līgumisko mantisko attiecību regulējuma salīdzinājums ar citām valstīm iespējams rada iespēju novērtēt vai ir kaut kas aizgūstams un piemērots Latvijas laulāto līgumisko mantisko attiecību regulējumam. Rezultātā autore nonāca pie secinājumiem, kāpēc laulību līgumi Latvijā ir it kā laulātajiem zināma lieta, bet nav tik bieži pielietota. Tāpat autore izdara secinājumus par laulību līgumu noslēgšanas nepieciešamību, tā saturu un nozīmi apsverot teorētiskās un praktiskās puses, plusus un mīnusus. Bakalaura darbā tiek izmantoti sekojoši atslēgvārdi: laulātie, laulība, laulību līgums, atsevišķā manta, kopīgā manta.

The topic of the bachelor's thesis is "Marriage contracts". In this work, the author studied the development of contractual matrimonial property relations in Latvia and modern regulation in order to understand why marriage contracts are necessary, why they are not concluded by each or every other couple. The regulation of property relations of spouses of other countries is also considered in order to assess the similarities and differences with the regulation of property relations of Latvian spouses. The comparison of the regulation of the contractual property relations of the Latvian spouses with other countries possibly creates an opportunity to assess whether something is available and suitable for the regulation of the contractual property relations of the Latvian spouses. As a result, the author came to the conclusions why marriage contracts in Latvia are a thing known to spouses, but it is not used so often. The author also came to the conclusions on the need for the conclusion of marriage contracts, its content and importance considering theoretical and practical sides, the benefits and the risks.
