Psiholoģiskās vardarbības krimināltiesiskais regulējums

Abstract

Bakalaura darba ietvaros autore analizē psiholoģiskās vardarbības kā vardarbības veida būtību, aplūkojot tās raksturojumu un kaitējumu, kas var iestāties tās pielietošanas rezultātā, kā arī salīdzinot to ar citiem vardarbības veidiem un identificējot būtiskākās atšķirības. Ar mērķi izprast psiholoģiskās vardarbības kā krimināli sodāmas rīcības saturu, tiek izpētīts psiholoģiskās vardarbības krimināltiesiskais regulējums Latvijas vēsturiskajos tiesību avotos, kā arī spēkā esošais regulējums Latvijā un ārvalstīs. Darba rezultātā autore secina, ka psiholoģiskā vardarbība ir viena no kaitīgākajām vardarbības formām, jo tā var ilgstoši palikt nepamanīta, taču nodarīt kaitējumu personas veselības un dzīvības interesēm. Autore identificē Latvijā spēkā esošā regulējuma nepilnības un izvirza priekšlikumus normatīvā regulējuma pilnveidošanai.

Within the framework of the bachelor’s thesis, the author analyses the nature of psychological abuse as a type of abuse, focusing on its characteristics and harm, which it may cause and compares it to other types of abuse, identifying the main differences between them. With the aim of understanding the content of psychological abuse as a criminal offence, the thesis gives an insight about the regulation of it in Latvian historical sources of law and the existing regulation in Latvia and abroad. As a result of the study, the author comes to a conclusion, that psychological abuse is one of the most harmful forms of abuse, considering the harm it may cause to the health and life of the victim, whilst staying unnoticed. The author identifies the flaws of the existing regulation and proposes ways in which the regulation may be improved.
