Progresīvā brīvības atņemšanas soda izpildes sistēma

Abstract

Bakalaura darba temats ir “Progresīvās brīvības atņemšanas soda izpildes sistēma.” Brīvības atņemšanas soda izpilde tiek īstenota atbilstoši progresīvai soda izpildei, kas izpaužas režīma pakāpeniskā mīkstināšanā vai pastiprināšanā un notiesāto pārvietojot no viena veida cietuma uz citu, ņemot vērā laiku, kāds ir pavadīts sākotnējā soda izciešanas režīma pakāpē, kā arī notiesāto uzvedību. Progresīvā soda izpilde pamatojas arī uz notiesāto diferencētu sadalījumu ieslodzījuma vietās. Darba mērķis ir izpētīt brīvības atņemšanas jēdzienu un tā saturu, kā arī izpētīt vēsturisko attīstību, izpētīt progresīvās brīvības atņemšanas soda izpildes sistēmu Latvijas ieslodzījuma vietās, noskaidrot brīvības atņemšanas soda progresīvās izpildes sistēmas regulējumu ārvalstīs. Lai tiktu sasniegts izvirzītais darba mērķis darba autore ir izvirzījusi šādus uzdevumus: 1) izpētīt brīvības atņemšanas soda būtību un jēdziena saturu, kā arī tā vēsturisko attīstību, 2) izpētīt, kā tiek īstenota progresīvā soda izpilde Latvijas ieslodzījuma vietās, 3) izpētīt brīvības atņemšanas un progresīvās soda izpildes sistēmas īstenošanu Latvijā un ārvalstīs. Pētījuma rezultātā darba autore secināja, ka, lai arī ir veikti uzlabojumi progresīvās brīvības atņemšanas soda izpildes sistēmā attiecībā uz pakāpju maiņu, kad no Latvijas Sodu izpildes kodeksa tika izslēgta slēgtā cietuma vidējā pakāpe, tik un tā ir novērojamas problēmas, piemēram, sievietēm par smagu vai sevišķi smagu noziegumu izdarīšanu ir iespēja ātrāk iegūt iespēju tikt pirms termiņa atbrīvotām no soda izciešanas, īslaicīga brīvības atņemšanas iestādes atstāšana nav iespējama tiem notiesātajiem, kuri atrodas daļēji slēgtā un slēgtā cietuma režīma zemākajā pakāpē. Kā arī ir paredzēts no trīs cietumu veidiem pāriet uz diviem, proti, atklāto un slēgto, izslēdzot daļēji slēgto cietumu. The subject of bachelor’s thesis is “The progressive imprisonment sentence enforcement.” The execution of imprisonment is implemented out according to progressive execution of sentence, which occurs by softening the penal mode or enforcing it and by transferring the convicted person from one prison to another based on the time spent in the initial penal serving regime, as well as the behavior of the convicted. Progressive execution of sentence is also based on a differentiated distribution of convicts in prisons. The aim of the work is to explore the concept of the execution of imprisonment sentence, as well as historical development, to clarify how the progressive execution of imprisonment sentence in Latvia prisons is being implemented and investigate the regulation of progressive enforcement system of imprisonment sentence abroad. To achieve the aim of the work author has set the following tasks: 1) find out the content of the execution of imprisonment sentence, as well as the development, 2) find out the implementation of the progressive imprisonment sentence enforcement in Latvian prisons, 3) find out the difference in Latvia’s regulation compared with the foreign regulation. As a result of the work, the author concluded that although improvements have been made to the progressive imprisonment sentence enforcement as regards the change of grades, when the average grade of closed prison was excluded from the Latvian Penitentiary code still there are problems in this system, for example, women who have committed a serious or particularly serious crime have the opportunity to be released earlier, it is not possible for those convicts who are in the lowest grade of the semi-closed and closed prison to leave the prison temporarily. It is also planned to move from three types of prisons to two, open and closed, to the exclusion of semi-closed prisons.
