Konstitucionālās sūdzības subjekts: atsevišķi problemātiskie aspekti

Abstract

Bakalaura darbs veltīts procesuālās tiesībspējas un procesuālās rīcībspējas problemātikai Satversmes tiesas procesā triju tiesību subjektu – mantojuma masas, atvasinātas publiskas personas un fiziskas personas divu juridisku kategoriju (nepilngadīgu personu un personu, kuru rīcībspēja ierobežota ar tiesas spriedumu veselības traucējumu dēļ) – kontekstā. Darba mērķis ir izpētīt, vai un kādā apmērā iepriekš nosauktajiem tiesību subjektiem piemīt procesuālā tiesībspēja un procesuālā rīcībspēja, kā arī analizēt konstitucionālās sūdzības subjektu loka tvērumu. Pētniecības rezultātā secināts, ka visi iepriekš norādītie tiesību subjekti ir procesuāli tiesībspējīgi pēc vispārīgā principa vai arī izņēmuma gadījumos.

The Bachelor’s Thesis is devoted to the problem of procedural legal capacity and procedural capacity in the Constitutional Court proceedings in the context of three legal subjects – entirety of property of an estate (mantojuma masa), derived public persons and natural persons of two legal categories (minors and persons with limited legal capacity due to a health condition). The aim of the Thesis is to study whether and to what extent the above-mentioned legal subjects have procedural legal capacity and procedural capacity, as well as to analyse the scope of the subjects of a constitutional complaint. It has been concluded that all the above-mentioned legal subjects have procedural legal capacity according to the general principle or in exceptional cases.
