Motīvs un mērķis: izpratne, norobežošana un problemātiskie aspekti

Abstract

Noziedzīga nodarījuma motīvs un mērķis (nolūks) ir noziedzīga nodarījuma subjektīvās puses papildu pazīmes. Motīvs ir ierosinātājs konkrēta mērķa sasniegšanai. Bakalaura darbā pētīts motīva un mērķa (nolūka) jēdzieniskais saturs, problemātiskie aspekti attiecīgo jēdzienu savstarpējā norobežošanā un to konstatēšanas nozīme krimināltiesību diskursā. Bakalaura darba mērķis ir izvērtēt noziedzīga nodarījuma motīva un mērķa problemātiskos aspektus saistībā ar to jēdzienisko saturu un tvērumu krimināltiesībās. Bakalaura darba mērķa sasniegšanai ir izvirzīti šādi uzdevumi: 1) izpētīt noziedzīga nodarījuma motīva un mērķa teorētiskos aspektus un vēsturisko attīstību saistībā ar jēdzienu saturu; 2) izanalizēt noziedzīga nodarījuma motīva un mērķa tvērumu, izpratni un nozīmi krimināltiesībās; 3) raksturot noziedzīga nodarījuma motīva un mērķa izpratni ārvalstu krimināltiesību diskursā. Bakalaura darba autore secina, ka motīvam un mērķim ir iekšēja saistība, jo katru gribas izpausmi ietekmē motīvi, kas sekmē noziedzīga mērķa sasniegšanu.

The motive and purpose of criminal offense are additional features of the subjective side of the criminal offense. A motive is an urge to achieve a specific goal. The Bachelor’s thesis studies the conceptual content of the motive and purpose, the problematic aspects in the mutual delimitation of the respective concepts and the importance of their determination in the discourse of criminal law. The aim of the Bachelor’s thesis is to evaluate the problematic aspects of the motive and purpose of criminal offense. The following tasks are advanced to achieve the set aim: 1) to study the theoretical aspects of the motive and purpose of criminal offense; 2) to analyse the scope of the motive and purpose of criminal offense in the criminal law; 3) to characterise the understanding of the motive and purpose of criminal offense in the discourse of foreign criminal law. The author of the Bachelor’s thesis concludes that motive and purpose have an intrinsic connection, since every expression of will is influenced by motives that contribute to the achievement of a criminal purpose.
