Lai atklātu noziegumus, tiesībsargājošajām iestādēm nākas pielietot ne tikai Kriminālprocesa likuma 10. nodaļā ietvertās izmeklēšanas darbības, bet arī speciālās izmeklēšanas darbības un operatīvo darbību. Savukārt gadījumos, kad noziegumi ir saistīti ar nelikumīgu narkotisko vielu apriti un korupciju, tad atkarībā no situācijas ir nepieciešams pielietot operatīvo vai speciālo izmeklēšanas eksperimentu. Abu eksperimentu pielietošana praksē ir saistāma ar augstu provokācijas risku, ko apliecina ne tikai Latvijas tiesu prakses, bet arī Eiropas Cilvēktiesību tiesas spriedumi. Tāpēc bakalaura darba “Provokācija un tās aizliegums Eiropas Cilvēktiesību tiesas praksē” ietvaros, balstoties uz juridisko literatūru, normatīvajos tiesību aktos noteikto, kā arī analizējot Eiropas Cilvēktiesību tiesas un Latvijas tiesu prakses nolēmumus, autors analizēja tiesiski nozīmīgus aspektus, kurus nepieciešams ievērot, lai netiktu pieļauta provokācija un citi pārkāpumi. To solve crimes, it can be necessary for law enforcement agencies to not only undertake investigation actions, which are included in Chapter 10 of the Criminal Procedure Law of Latvia, but it can also be necessary to use special investigative actions or operational investigative activities. However, particularly in cases when crimes are related to illegal drug trafficking or corruption, depending on the situation, it can be necessary to perform special investigative or operational experiments. In legal practice, both experiments have been associated with a high risk of provocation, which is inferred not only by Latvian court judgments but from European Court of Human Rights judgments as well. Therefore in this paper, by researching legal literature, normative acts, and judgments of Latvian courts and the European Court of Human Rights, the author got acquainted with the most important aspects that have to be taken into account to prevent provocation and other violations.
