Resocializācija kā soda izciešanas mērķis no bērna labāko interešu aspekta

Jautājumi, kas saistīti ar bērnu tiesībām, jo sevišķi ar nepilngadīgo noziedzības problēmām, savu aktualitāti nezaudē nekad. No vienas puses, bērni sabiedrībā bauda īpašu aizsardzību, jo tie ir ierobežoti tiesībās, tiem nav vēl nepieciešamā intelektuālā brieduma un attīstības, lai spētu patstāvīgi iekļauties sabiedrībā. No otras puses, bērniem ir pienākumi, kurus ir jāievēro. Ja bērni pārkāpj šos pienākumus, par to ir jāuzņemas atbildība, tomēr, neraugoties uz valsts reformēto kriminālsodu pieeju attiecībā uz nepilngadīgajiem, tiesiskajā realitātē pamanāmi trūkumi, kuri var nesamērīgi ierobežot pie noteiktas grupas piederošas personas pamattiesības. Darba mērķis ir izpētīt vai resocializācija kā soda izciešanas mērķis atbilst bērna interesēm un nodrošina iespēju pilnvērtīgi iekļauties nākotnes sabiedrībā. Pētījuma robežas pamatā attiecināmas uz personām vecumā no 14 līdz 18 gadiem (nepilngadīgie). Šobrīd spēkā esošajā tiesiskajā regulējumā attiecībā uz nepilngadīgajiem ir saskatāmi trūkumi, kas var kavēt sasniegt valsts izvirzīto mērķi – pieauguša bērna veiksmīgu integrāciju sabiedrībā. Issues related to children's rights, especially juvenile delinquency, may never lose their relevance especially nowadays. On one hand, children enjoy special protection in society because they are limited in their rights, they do not yet have the necessary intellectual maturity and development to be able to integrate independently into society. On the other hand, the child has responsibilities which must be respected. If a child violates these obligations, he or she must be held responsible. However, despite the reformed criminal penalties policy of the State with regard to juveniles, there are gaps in the legal framework. It shows shortcomings that can disproportionately restrict the fundamental rights of a person belonging to a certain group. The aim of the Bachelor's thesis is to analyse whether re-socialisation as a goal of serving a sentence is in the best interests of the child and ensures the possibility of full integration into the future society. The research is mainly limited to persons age gap from 14 to 18 (juveniles). The current legal framework for juveniles has shortcomings which may hinder the achievement of the State's objective of the successful integration of the adult child into society.
