Ietekmētāju mārketings ir īpaša reklāmas forma, kuru, pateicoties patērētāju dabiskajai tendencei uzticēties ietekmētāju viedoklim, var efektīvi izmantot slēptai patērētāju izvēles ietekmēšanai. Patērētājam, uzticoties ietekmētāju sniegtajai informācijai, bet neesot informētam par tās komerciālo nolūku noved pie to maldināšanas, kas līdz ar to uzskatāma par negodīgas komercprakses īstenošanu. Bakalaura darbā “Ietekmētāju maldinošā komerciāla nolūka noklusēšana Latvijā” aplūkotā aktuālā Latvijas un citu ES dalībvalstu tiesu prakse saistībā ar ietekmētāju reklāmas komerciālā nolūka izpaušanu. Galvenā problēma ietekmētāju maldinošās noklusēšanas aspektā ir patērētāju grūtības nošķirt komerciālu saturu no ietekmētāja personīgā viedokļa. Pētījumā tiek analizēts kāpēc, kādās situācijās un kādā veidā ietekmētājam ir pienākums nošķirt apmaksātas reklāmas no privātajām publikācijām. Tāpat darba ietvaros autore analizē Latvijas ietekmētāju publikācijas sociālajā tīklā Instagram, lai noskaidrotu galvenos problēmjautājumus un to atbilstību Negodīgas komercprakses direktīvai. Influencer marketing is a unique form of advertising that, due to the natural tendency of consumers to trust the opinions of influencers, can be used effectively to affect consumer choices. When consumers are not informed of the commercial intent of the content influencer shares, they are being misled, which is therefore to be regarded as an unfair commercial practice. In the bachelor's thesis “Misleading omission of commercial intent by influencers in Latvia” author has examined Latvian and other EU member states case law in connection with the obligation to disclose the commercial intent. The most pressing issue in terms of misleading omission by influencers is the difficulty for consumers to distinguish commercial content from the influencer's personal point of view. The study analyzes why, in what situations and how the influencer has to distinguish between paid and private publications. Also, within the research, the author analyzes the publications of Latvian influencers on the social network Instagram in order to find out the main problems and their compliance with the Unfair commercial practices directive.
