Mantojums ir kopība, kurā ietilpst visa kustamā un nekustamā manta, kā arī citiem atdodamās tiesības un saistības. Cilvēkam, esot laulībā, mantas iegūšana var notikt kopā ar otru laulāto. Civillikums nosaka to, ka kopīga manta nav tikai tad, ja abu finansiālais ieguldījums ir vienāds, bet tā var būt kopīga, ja to iegūst viens no viņiem, bet ar abu laulāto līdzekļiem vai ar otra laulātā darbības palīdzību. Bakalaura darba mērķis ir, izpētot normatīvajos aktos esošo regulējumu un tiesu praksi par pārdzīvojušā laulātā mantojuma tiesībām un tiesībām uz viņa daļas nodalīšanu, apzināt problēmas, kas ar to saistītas un, ja iespējams, meklēt to risinājumu. Papildus tam, autore darbā apskata izaicinājumus un piemērošanas grūtības, kas saistītas ar 2012. gadā Eiropas Parlamenta un Eiropas Savienības padomes pieņemto regulu Nr.650/2012, kura skar arī mantojuma tiesību jautājumus ar pārrobežu elementiem. An estate is the whole, which comprises all immovable and movable property, as well as transferable rights and obligations, which may be transferred to others and which, at the actual or legally presumed time of death. When a person is married, the acquisition of property can take place together with the other spouse. Civil law states that joint property is not only if the financial contribution of both is the same, but it can be joint if it is acquired by one of them, but with the assistance of the actions of the other spouse The objective of the bachelor work is to identify problems related to the successful realization of these rights by examining the regulatory frameworks and case-law regarding the rights of the surviving spouse and rights to divide his or her share, and, if possible, to seek solutions for these problems. In addition, the author examines the challenges and difficulties of application related to the Regulation No. 650/2012 adopted by the European Parliament and the Council of the European Union in 2012, which also concerns issues of inheritance law with cross-border elements.
