Bakalaura darba mērķis ir analizēt neatņemamās daļas tiesīgo atstumšanas no mantojuma tiesisko regulējumu un vērtēt tā nepieciešamību mūsdienās Latvijas Republikas Civillikuma Mantojuma tiesību daļā. Attiecīgais tiesību institūts ir novecojis un neatbilstošs mūsdienu sabiedriskajai apziņai un valsts tiesiskajai iekārtai. Darbā tiek pētīta un analizēta neatņemamās daļas un neatņemamās daļas tiesīgo atstumšanas no mantojuma tiesību institūtu izcelsme un attīstība, kā arī sīkāk analizēti CL 427., 428., 429. un 431. pants. Darba gaitā tiek pamatota neatņemamās daļas un neatņemamās daļas tiesīgo atstumšanas no mantojuma tiesību institūtu izslēgšanas no CL nepieciešamība, paredzot jaunu tiesisko regulējumu, kas radītu līdzsvaru starp testatora un neatņemamās daļas tiesīgo interesēm. The aim of the bachelor’s thesis is to analyze the legal regulation of the exclusion from inheritance and to assess its necessity nowadays in the Inheritance Law section of the Civil Law of the Republic of Latvia. The relevant institute of law is outdated and inconsistent with modern public consciousness and the national legal system. The author examines and analyzes the origin of the institutes of law such as the preferential share and the exclusion from inheritance, as well as Articles 427, 428, 429 and 431 of the Civil Law are analyzed in more detail. The need to exclude the institutes of inheritance law from the Civil Law such as the preferential share and the exclusion from inheritance, providing a new legal framework that would create balance between the interests of the testator and those who are entitled to preferential share is also substantiated.
