Nekustamā īpašuma pārdošana izsolē

Abstract

Bakalaura darbā tiek pētīts Latvijas normatīvais regulējums, kas reglamentē nekustamā īpašuma pārdošanu izsolē. Likumā ir atrunātas divu veidu nekustamo īpašumu izsoles – nekustamā īpašuma labprātīga pārdošana izsolē, kur sākumcenu un nosacījumu noteikšana izriet no lietas dalībnieku ieskata, un piespiedu pārdošana izsolē, kur izsoles norises kārtība ir sīki atrunāta, piemēram, izsoles sākumcena parasti ir par 30 līdz 40% zemāka nekā īpašuma reālā tirgus cena. Bakalaura darba galvenais mērķis ir apskatīt kā un kādos gadījumos īpašnieka nekustamais īpašums var nonāk izsolē un, sekojoši, izsoles vispārīgie noteikumi. Pētījumā izmantotas Latvijas tiesību normas un tiesību prakse. Lai sasniegtu izvirzītos mērķus, darba autore aplūko nekustamo īpašumu regulējumu, ņemot vērā tā apgrūtinājumus un analīzē procesuālas normas attiecībā uz izsoles veidu. Darba izstrādes laikā secināts, ka veiktie grozījumi saskaņā ar izsoles pāreju uz elektronisko vietni ir pozitīvi ietekmējuši veikto darbu, kā arī citi secinājumi un piedāvāti priekšlikumi par nekustamā īpašuma pārdošanu izsolē.

The bachelor thesis examines the Latvian legislation regulating the sale of real estate by auction. The law provides for two types of real estate auctions - voluntary auctioning, where the starting price and conditions are at the discretion of the parties, and forced auctioning, where the procedure for the auction is detailed, e.g. the starting price is usually 30-40 % lower than the real market price of the property. The main objective of the bachelor thesis is to look at how and in which cases an owner’s immovable property can be put up for auction and, consequently, the general rules of an auction. The study is based on Latvian law and legal practice. In order to achieve the set objectives, the author of the thesis examines the regulation of real estate in the light of his encumbrances and analyses procedural rules regarding auctions. The thesis concludes that the amendments made under the auction’s transition to an electronic site have had a positive impact on the work carried out, as well as other conclusions and offers suggestions for the sale of real estate at auction.
