Atzīšanas prasība civilpocesā

Abstract

Bakalaura darba “Atzīšanas prasības civilprocesā” pētījuma aktualitāte saistāma ar personas tiesībām celt tiesā atzīšanas prasību savu ar likumu aizsargājamo interešu aizsardzībai. Šādas tiesības pieskaitāmas personas tiesībām uz taisnīgu tiesu. Darba mērķis ir noskaidrot CPL 1.p. saturu, izpētīt un analizēt atzīšanas prasības vietu un lomu civilprocesā, kā arī noskaidrot personas tiesību uz taisnīgu tiesu kopsakarību ar personas tiesībām vērsties tiesā, ceļot atzīšanas prasību, sniegt pilnveidotas atsevišķu terminu definīcijas, kā arī pierādīt, ka CPL 1.p. spēkā esošā redakcija ir pilnīga un nav nepieciešama tā uzlabošana. Mērķa sasniegšanai tika veikti šādi darba uzdevumi: apzinātas un analizētas atzīšanas prasības institūtā pastāvošās problēmas, sniegti priekšlikumi to risināšanai; izpētīta un analizēta atzīšanas prasība, tās vieta un loma civilprocesā; veikta CPL 1.p. iztulkošana, apskatīti un analizēti atzīšanas prasību civilprocesuālie aspekti, personas tiesības uz taisnīgu tiesu atzīšanas prasībās, tiesu prakse atzīšanas prasībās, kā arī noskaidrota tiesas rīcība atzīšanas prasības celšanas priekšnosacījumu vērtēšanā. Darba gaitā sasniegti šādi rezultāti - izpētīta atzīšanas prasība, tās vieta un loma civilprocesā, izanalizēti atzīšanas prasības civilprocesuālie aspekti un personas tiesības uz taisnīgu tiesu atzīšanas prasībās, sniegtas pilnveidotas atsevišķu terminu definīcijas, kā arī pierādīts, ka CPL 1.p. spēkā esošā redakcija ir pilnīga un nav nepieciešama tā uzlabošana. Topicality of the research of Bachelor’s Thesis “Declaratory Claims In Civil Proceedings” is related to the rights of a person to submit a declaratory claim for the protection of interests protected by law. This right includes a person's rights to a fair trial. The aim of the work is to clarify the content of Article 1 of the Civil Procedure Law, to study and analyze the place and role of the declaratory claim in civil proceedings, as well as to clarify the connection of a person's righs to a fair trial with person's right to submit a declaratory claim; to provide improved definitions of certain terms; as well as to prove that Article 1 of the Civil Procedure Law in the current version is complete and does not need to be improved. In order to achieve the goal, the following tasks were performed: the problems of the institute of declaratory claim were identified and analyzed, proposals for their solution were provided; declaratory claim, its place and role in civil proceedings have been studied and analyzed; interpretation of Article 1 of the Civil Procedure Law was performed, civil procedural aspects of declaratory claims, person's rights to a fair trial in declaratory claims, case-law of declaratory claims, as well as the court's action in assessing the preconditions for submitting a declaratory claim has been clarified. In the course of the work the following results have been achieved - the declaratory claim, its place and role in civil proceedings have been studied, the civil procedural aspects of declaratory claim and a person's rights to a fair trial in declaratory claims have been analyzed, improved definitions have been provided, and it has been proved that Article 1 of the Civil Procedure Law in the current version is complete and does not need to be improved.
