Cilvēka audu un orgānu nelikumīga izņemšana- tiesiskais regulējums

Abstract

Bakalaura darba “Cilvēka audu un orgānu nelikumīga izņemšana – tiesiskais regulējums” aktualitāte ir saistīta ar tehnoloģiju attīstību, kas paver arvien jaunas iespējas medicīnas attīstībai, slimību ārstēšanai un arī cilvēku dzīvību glābšanai. Viena no šādām medicīnas jomām, kura pēdējā pusgadsimta laikā ir strauji attīstījusies, ir audu un orgānu izņemšana dažādiem nolūkiem. Šī iemesla dēļ ir nepieciešams arī atbilstošs, konkrēts tiesiskais regulējums. Bakalaura darbā tika izvirzīts mērķis izpētīt Latvijas un starptautisko regulējumu par audu un orgānu izņemšanu, izpētīt starptautiskā regulējuma ietekmi uz Latvijas tiesību normu attīstību, analizēt Krimināllikuma 139. pantā ietvertā noziedzīgā nodarījuma sastāvu. Balstoties uz normatīvo regulējumu un zinātnisko literatūru bakalaura darba rezultātā izdarīti secinājumi par spēkā esošo tiesisko regulējumu audu un orgānu izņemšanas jomā, kā arī sniegti ieteikumi tiesiskā regulējuma pilnveidošanai.

The relevance of the bachelor's thesis "Illegal removal of human tissues and organs - legislation" is associated with the development of technologies that open up new opportunities for the development of medicine, the treatment of diseases, as well as saving lives. One such area of medicine, which has developed rapidly over the past half century, is the removal of tissues and organs for various purposes. For this reason, an appropriate, specific legal framework is also needed. The purpose of the bachelor's thesis was to study the Latvian and international rules for the removal of tissues and organs, to study the influence of international rules on the development of Latvian legislation, to analyze the composition of a criminal offense included in Article 139 of the Criminal Law. Based on the legal framework and scientific literature, at the results of the bachelor's thesis, were made conclusions about the current regulatory framework in the field of human tissue and organ removal, and were made recommendations to improve the regulatory framework.
