Maģistra darbā “Eiropas Savienības tiesību pārākuma principa piemērošanas robežas Satversmes tiesā” sniegts ieskats jautājumos par Eiropas Savienības tiesību pārākuma principa nepieciešamību, tvērumu un to piemērošanu. Tiek meklēta atbilde uz pētāmo jautājumu “Kādos gadījumos Satversmes tiesai pamatojoties uz Eiropas Savienības tiesību pārākuma principu ir jādod prioritāte Eiropas Savienības tiesībām pār Latvijas nacionālo tiesību aktu?”. Darba mērķis ir atklāt problēmjautājumus principa piemērošanas robežās, kā arī vietu Latvijas tiesību sistēmā. Attiecīgais jautājums līdz šim tiek pētīts tikai daļēji, arī pati Satversmes tiesa izvairās no tiešas atbildes sniegšanas. Pētījuma rezultātā tiek konstatētas Eiropas Savienības tiesību principa piemērošanas robežas un kolīziju novēršanas iespējas. The Master's work “The limits of application of the principle of the supremacy of European Union law in the Latvian Constitutional Court” provides an insight into issues concerning the necessity, scope and application of the principle of supremacy of European Union law. The author will try to find an answer to the question “In what cases should the Constitutional Court give primacy of the European Union law over the Latvian national law on the basis of the principle of supremacy?”. The aim of the work is to reveal problems in applying the principle, and its place in the Latvian legal system. The question has been studied only partially so far, and the Constitutional Court itself avoids giving a direct response. The study finds the scope for the principle of the supremacy of and the possibilities for conflict-of-law prevention.
