Abstract

Maģistra darbs “Tiesību uz taisnīgu tiesu nodrošināšana, izvēloties lietas iztiesāšanas veidu – mutvārdu vai rakstveida procesā” sniedz ieskatu tiesību uz taisnīgu tiesu jēdzienā, saturā un regulējumā, izpēta to nodrošināšanu gan rakstveida, gan mutvārdu procesā, salīdzina ārvalstu regulējumus un izzina tiesību uz taisnīgu tiesu pārkāpuma sekas. Darba gaitā tiek vērsta uzmanība uz izvēlētā procesa veida iespējamiem trūkumiem un pārkāpumiem. Darba kopsavilkumā tiek sniegti secinājumi par tiesību uz taisnīgu tiesu īstenošanu procesa veida izvēlē Kriminālprocesa likumā un priekšlikumi Kriminālprocesa likuma grozījumiem, lai novērstu iespējamos tiesību uz taisnīgu tiesu pārkāpumus un pilnveidotu kriminālprocesuālo regulējumu.

The master's thesis “Ensuring the rights to a fair trial, choosing the type of case trial - oral or written process” provides an insight into the concept, content and regulation of the right to a fair trial, studies their provision in both written and oral proceedings, compares foreign regulations and examines the right to a fair trial the consequences of the infringement. In the course of the work, attention is paid to possible shortcomings and violations of the chosen type of process. The summary of the thesis provides conclusions on the implementation of the right to a fair trial in the choice of process in the Criminal Procedure Law and proposals for amendments to the Criminal Procedure Law in order to prevent possible violations of the right to a fair trial and improve the criminal procedure regulation.
