Iesniegtā piedāvājuma precizēšana publiskā iepirkuma procedūras ietvaros

Abstract

Iesniegto piedāvājuma vērtēšana iepirkumu procedūrā ir viens no nozīmīgākajiem posmiem, lai īstenotu pasūtītāja vajadzības un noslēgtu līgumu. Tomēr iesniegtā piedāvājuma vērtēšana un tieši piedāvājuma precizēšanas jautājumi, ir vieni no sarežģītākajiem un aktuālākajiem jautājumiem, ar kuriem ik dienu saskaras pasūtītāji, kuri katrā no atsevišķiem gadījumiem vērtē piedāvājumus atbilstoši gan iepirkuma dokumentācijā noteiktajām prasībām, gan atbilstoši likumam, gan saskaņā ar publisko iepirkumu principiem. Lai gan Publisko iepirkumu likuma 41.pants nosaka vispārīgums pamatprincipus piegādātāju atlasē un pieļauj iespēju precizēt iesniegto informāciju, pasūtītājam ir jāspēj noteikt tiesību normas saturs un robežas, cik atbilstoši likuma regulējumam un publisko iepirkumu principiem, ir pieļaujama šādas papildus informācijas iesniegšana. Maģistra darba mērķis ir noskaidrot jēdziena “piedāvājuma precizēšana” saturu, kā arī apskatīt piedāvājumu precizēšanas problemātiku, analizējot piedāvājumu precizēšanas prakses piemērus. Šajā darbā ir analizēti atbilstoši Publisko iepirkumu likuma regulējumam izsludināti iepirkumi. Maģistra darba pamatā tiek analizēti prakses piemēri un judikatūra, jo Latvijā nav pieejama zinātniskā literatūra vai periodika par publiskā iepirkumā iesniegta piedāvājuma precizēšanas jautājumiem.

The evaluation of the submitted tenders in the procurement procedure is one of the most important stages in order to carry out the needs of the Contracting Authority and conclude a contract. However, submitted tender's evaluation and precisely the aspects of clarification of tender are one of the most difficult and topical issues that contracting authorities are facing daily, who in each individual case assess the conformity of tenders in accordance with the requirements specified in the procurement documentation, as well as in accordance with laws and regulations, and with the public procurement principles. Although Section 41 of the Public Procurement Law of the Republic of Latvia defines general basic principles in the process of selection of suppliers and considers a possibility to clarify the submitted information, the Contracting authority has to be able of determine the content and limitations of the legal norm, namely, to what extent such submission of the additional information is acceptable in accordance with the law and the principles of public procurement. The purpose of the master thesis is to determine the content of the concept of "clarification of the tender", as well as to look into the issues of the clarification of tenders, while analyzing the practical examples of the tender clarification. Within the content of these thesis there are analyzed specific public procurements that are published in accordance with the Public Procurement Law of the Republic of Latvia. As the base of this master thesis are analyzed practical examples and case law due to the fact that there are no scientific literature or periodicals available in the Republic of Latvia as regards to the the clarifications of the tenders submitted in the procurement procedure.
