Surogācijas procesa legalizēšanas nepieciešamība Latvijā

Surogācijas process ir medicīniskās apaugļošanas veids, kurā sievietei (surogātmātei) tiek transplantēts medicīniski radīts embrijs nolūkā iznēsāt un nodot bērnu pasūtītāju (saņēmējvecāku) turpmākā aizgādībā. Latvija ir viena no tām valstīm, kas līdz šim brīdim ir izvēlējusies ignorēt surogācijas procesa pastāvēšanu, neieviešot tā normatīvo regulējumu. Tomēr surogācijas procesi notiek arī Latvijā, un tik pasīva valsts pozīcija izraisa virkni risku kā surogātmātēm, tā arī saņēmējvecākiem, un, kas ir visbūtiskākais – bērniem. Bakalaura darba mērķis ir noteikt riskus, kas saistīti ar surogācijas procesa nenoregulēšanu un nelegalizēšanu, kā arī izstrādāt iespējamo surogācijas procesa regulējuma modeli Latvijā. Darba rezultātā tika noteikts surogācijas procesa nenoregulēšanas risku uzskaitījums, kā arī izstrādāts iespējamais normatīvais regulējums procesa legalizēšanai. The surrogacy process is a type of medical fertilization in which a woman (surrogate mother) is transplanted with a medically created embryo for the purpose of carrying and transferring the child to the further custody of the acquirers (receiving parents). Latvia is one of those countries that until now have chosen to ignore the existence of the surrogacy process without introducing its regulatory framework. However, surrogacy processes also take place in Latvia, and such a passive position of the country leads to a number of risks for surrogate mothers, receiving parents, and, most importantly, for children. The aim of the Bachelor's thesis is to identify the risks associated with non-regulation and illegalization of the surrogacy process, as well as to develop a possible model for the regulation of the surrogacy process in Latvia. As a result of the work, a list of risks of non-regulation of the surrogacy process was determined, as well as a possible regulatory framework for legalizing the process was developed.
