Apsūdzība un tās grozīšana pirmstiesas procesā

Abstract

Bakalaura darbs ir par apsūdzību un tās grozīšanu kriminālprocesā, koncentrējoties tieši uz pirmstiesas procesu. Bakalaura darbā tiek apkopota informācija par apsūdzības kā lēmuma problemātiku, galvenokārt izmantojot tiesu prakses un tiesību zinātnieku atziņas. Bakalaura darba mērķis ir analizēt apsūdzības un tās grozīšanas pirmstiesas procesā normatīvo regulējumu, izpētīt pašreizējās problēmsituācijas un atrast tām cēloņus normatīvajā regulējumā. Bakalaura darba rezultātā ir izveidoti ierosinājumi Kriminālprocesa likuma pilnveidošanai, tai skaitā, normatīvā regulējuma papildinājumiem un labojumiem, saistībā ar dažādiem apsūdzības un tās grozīšanas aspektiem, kas ir vērsti uz vienveidīgu prakses veidošanu un pirmstiesas procesa kļūdu novēršanu.

The bachelor's thesis is about the indictment and amending it in the criminal proceedings, focusing mainly on the pre-trial proceedings. In the bachelor's thesis information is gathered about the issues of the indictment, mainly using court practice and the insights of legal scholars. The aim of the bachelor's thesis is to analyze the regulatory framework of the indictment and amending it during the pre-trial process, to study the current problem situations and to find their causes in the regulatory framework. As a result of the bachelor's thesis, proposals have been made for the improvement of the Criminal Procedure Law, including additions and corrections to the regulatory framework, in connection with various aspects of the indictment and amending it, which are aimed at creating a uniform practice and preventing errors in the pre-trial process.
