Bakalaura darbā “Atbildību mīkstinošie apstākļi krimināltiesībās” autore aplūko Krimināllikuma 47.pantā noteiktos apstākļus, kuriem ir būtiska loma soda noteikšanā, sniedzot iespēju sodu mazināt. Atbildību mīkstinošie apstākļi ir piedzīvojuši būtiskus grozījumus, kā arī judikatūras iespaidā ir izveidojušies apstākļu piemērojamības priekšnoteikumi, kuri ietekmē apstākļu piemērojamību. Vērtējot tiesu praksi, kā arī šobrīd spēkā esošo atbildību mīkstinošo apstākļu regulējumu, var manīt problemātiku apstākļu priekšnoteikumu piemērošanā, kā arī Krimināllikuma 47.panta struktūrā. Tiesu praksē nereti nav vienprātība par apstākļu priekšnoteikumu interpretāciju, tādejādi tiesas pakļauj atbildību mīkstinošos apstākļus interpretācijas problemātikai, kas var rezultēties ar nepareiza soda mēra noteikšanu un tādejādi būtiski var ietekmēt vainīgās personas tiesiskās intereses. Darba mērķi ir izpētīt atbildību mīkstinošo apstākļu interpretācijas problemātiku tiesu praksē, kā arī izpētīt Krimināllikuma 47.panta struktūru. Lai sasniegtu mērķi, tiks analizēta tiesu judikatūra, aplūkotas dažādu tiesībzinātnieku atziņas, salīdzināts tiks pašreizējais atbildību mīkstinošo apstākļu regulējums ar tiesu praksē rodamajām atziņām. Tiks aplūkots ārvalstu regulējumus un salīdzināts ar Latvijas pastāvošo regulējumu. Bakalaura darbā, autore norāda uz panta problemātiku, kā arī sniedz iespējamo risinājumu. In her bachelor's thesis "Mitigation of responsibility in criminal law", the author examines the circumstances defined in Article 47 of the criminal law, which play a significant role in determining the punishment, providing an opportunity to reduce the punishment. The mitigating circumstances have undergone significant changes, as well as the precedents for the applicability of the circumstances, which affect the applicability of the circumstances, have been created under the influence of jurisprudence. Evaluating court practice, as well as the currently valid regulation of mitigating circumstances, one can notice problems in the application of the prerequisites of the circumstances, as well as in the structure of Article 47 of the Criminal Law. In court practice, there is often no consensus on the interpretation of the preconditions of the circumstances, so the courts expose mitigating circumstances to the problem of interpretation, which can result in the determination of the wrong punishment and thus can significantly affect the legal interests of the guilty person. The aim of the work is to investigate the problematic interpretation of mitigating circumstances in court practice, as well as the structure of Article 47 of the Criminal Law. In order to achieve the goal, court jurisprudence will be analyzed, the findings of various jurists will be examined, and the current regulation of mitigating circumstances will be compared with the findings found in court practice. Foreign regulations will be examined and compared with the existing regulation of Latvia. In her bachelor's thesis, the author points out the problems of the article, as well as provides a possible solution.
