Vairāk kā divdesmit gadus pastāv iespēja piešķirt Eiropas Savienības Vispārējai tiesai kompetenci sniegt prejudiciālus nolēmumus. Jautājums par šādas kompetences nodošanu Vispārējai tiesai vairākkārt ir bijis darba kārtībā, tomēr reālas izmaiņas nav veiktas. 2022. gada novembrī Tiesa iesniedza Eiropas Komisijai lūgumu grozīt 3. protokolu Eiropas Savienības Tiesas statūtos. Lūguma mērķis ir samazināt Tiesas darba noslodzi, nododot daļu prejudiciālu lūgumu prasības Vispārējai tiesai. Darbā tiek apskatītas Vispārējās tiesas kompetences līdz šim, analizēts iesniegtais lūgumus un tiek identificētas tā iespējamās problēmas. Autore apskata arī citus variantus, ko Tiesa varēja izvēlēties. Darba gaitā autore nonākt pie secinājumiem, ka šādas izmaiņas ir nepieciešamas un ar iesniegto lūgumu ir sasniedzams tā izvirzītais mērķis. For more than twenty years, there has been an opportunity to give the General Court of the European Union the competence to give preliminary rulings. The issue of transferring such competence to the General Court has been on the agenda several times, but no real changes have been made. In November 2022, the Court of Justice submitted a request to the European Commission to amend Protocol 3 in the Statute of the Court of Justice of the European Union. The purpose of the request is to reduce workload of the Court of Justice by transferring part of the preliminary requests to the General Court. The work examines the competences of the General Court so far, analyzes the submitted request and identifies its potential problems. The author also examines other options that the Court could have chosen. In the course of the work, the author concluded that such changes are necessary and that the proposed goal can be achieved with the submitted request.
