Abstract

Mūsdienās arvien svarīgāka paliek cilvēktiesību nostiprināšana, ievērošana un attīstīšana. Tomēr saistībā ar kriminālprocesa ilgumu šīs tiesības ir vispārīgi definētas, kas, savukārt, rada risku šo tiesību ievērošanai. Tiesības uz kriminālprocesa pabeigšanu saprātīgā termiņā ir viens no kriminālprocesa pamatprincipiem, tomēr tam ir vairāki šķēršļi, kas šīs tiesības ierobežo un šī termiņa ievērošana ir diezgan problemātiska. Šī problēma vēl joprojām ir aktuāla un tā kā likums neparedz detalizētus laika ierobežojumus, tad ar šo tiesību ievērošanu var tieši vai netieši manipulēt. Šī pētījuma mērķis ir izprast tiesību uz kriminālprocesa pabeigšanu saprātīgā termiņā nozīmi, saprast šo tiesību pārkāpuma iemeslus un sekas. Pētījuma uzdevums ir izpētīt un izvērtēt tiesību uz kriminālprocesa pabeigšanu saprātīgā termiņā pārkāpumus, izdarīt par tiem secinājumus, tādējādi meklēt risinājumus, kā šīs problēmas novērst. Darba gaitā izdarītie secinājumi un izvērtējumi ļaus izprast tiesību uz kriminālprocesa pabeigšanu saprātīgā termiņā nozīmi un pavērs skatu uz kriminālprocesu no cita skatupunkta. Strengthening, respecting and developing human rights is becoming more and more important nowadays. However, due to the length of criminal proceedings, these rights are generally defined, which in turn creates a risk for the observance of these rights. The right to complete the criminal process within a reasonable time is one of the basic principles of the criminal process, however, there are several obstacles that limits these rights and compliance with this time limit is quite problematic. This problem is still relevant and since the law does not provide for detailed time limits, the observance of these rights can be directly or indirectly manipulated. The purpose of this study is to understand the importance of the right to complete criminal proceedings within a reasonable time, to understand the reasons and consequences of the violation of this right. The task of the study is to investigate and evaluate violations of the right to complete criminal proceedings within a reasonable time, to draw conclusions about them, and thus to look for solutions to eliminate these problems. The conclusions and evaluations made in the course of the work will make it possible to understand the importance of the right to the completion of criminal proceedings within a reasonable period of time and will open up a view of the criminal proceedings from a different point of view.
