Mūsdienu tiesiskajā realitātē Satversmes 92.pants paredz personai tiesības prasīt atbilstīgu atlīdzinājumu par pret personu nepamatoti uzsāktu kriminālprocesu. Ir radīti normatīvie regulējumi šāda veida procedūrai, bet attiecīgie regulējumi nebūtu uzskatāmi par pilnīgiem, un tajā ir rodamas pietiekami daudz neskaidrības saistībā ar pētāmajiem jautājumiem. Šī iemesla dēļ bakalaura darba ietvaros tiek pētīta zaudējumu atlīdzība par nepamatoti uzsāktu kriminālprocesu uz Krimināllikuma 195.panta pamatiem. Bakalaura darba ietvaros tiks izmantoti pašreiz spēkā esošie, gan nacionālie, gan ārvalstu normatīvie regulējumi un tiesu prakse, tiesību doktrīna, EST un ECT tiesu prakse, lai rastu atbildes uz praksē aktualizējušajiem problēmjautājumiem saistībā ar kriminālprocesā nodarīto zaudējumu atlīdzināšanas regulējumiem un to īpatnībām, kā arī par pašu zaudējumu atlīdzināšanu. Darba ietvaros autors sniegs spēkā esošā normatīvā regulējuma skaidrojumus un ieteikumus tā pilnveidei. In today’s legal reality, Article 92 of the Satversme provides for the right of a person to claim commensurate compensation for criminal proceedings wrongfully initiated against him. Statutory regulations have been created for this type of procedure, but the relevant regulations should not be considered as complete, and there is a sufficient amount of ambiguity in relation to the issues under study. For this reason, the bachelor thesis examines the compensation for damages for wrongful initiated criminal proceedings on the basis of Article 195 of the Criminal Law. The bachelor thesis will use the current national and foreign legal regulations and case law, legal doctrine, case law of the ECJ and the ECtHR in order to find answers to the problems that have arisen in practice in relation to the regulations and peculiarities of damages in criminal proceedings, as well as to the damages themselves. The author will provide explanations of the existing legal framework and recommendations for its improvement.
