Bāriņtiesu reforma Latvijā

Abstract

Bakalaura darbs aplūko 2021.gadā Latvijā veiktos grozījumus Bāriņtiesu likumā, kas dēvēti par “bāriņtiesu reformu”. Vispirms izvērtēts vēsturiskais bāriņtiesu tiesiskā regulējuma veidošanās process. Tālāk aplūkoti paši Bāriņtiesu likuma grozījumi un to ieviešanas iemesli. Darba trešajā daļā analizēti reformā vēl neiekļautie jautājumi, kas sabiedrības un jomas profesionāļu vidū atzīti par būtiskiem turpmākiem soļiem bērnu tiesību aizsardzības sistēmas pilnveidošanai. Bakalaura darbā izskatīts reformas apjoms, veikto grozījumu pamatojums un analizēta citu būtisku pārmaiņu nepieciešamība, veicot salīdzinājumu ar citu valstu praksi un vēsturiskajiem bāriņtiesu darbības principiem. Darba rezultātā autore piedāvā priekšlikumus turpmākiem grozījumiem bāriņtiesu darbības regulējumā Latvijā.

The bachelor's thesis examines amendments to the Law on Orphans' Courts made in Latvia in 2021, known as the “orphans' court reform”. First the historical formation process of the legal regulation of orphans' courts is evaluated. Further the amendments to the Law on Orphans' Courts themselves and the reasons for their implementation are discussed. The third part of the paper analyses the issues not yet included in the reform, which are recognized by the public and professionals as important further steps for improving the children rights protection system. The bachelor's thesis examines the scope of the reform, the rationale of the amendments and analyses the need for other significant changes, in comparison with the practice in other countries and the historical operating principles of orphan courts. At the end author offers proposals for further amendments to the regulation of orphan courts in Latvia.
