Pētījuma mērķis ir veikt vispārēju Krimināllikuma 74.1 panta analīzi, lai varētu noskaidrot panta attīstības īpatnības kopš tā iekļaušanas Krimināllikumā 2009.gadā, kā ari veikt secinājumus par panta piemērošanu praksē. Pētījuma uzdevumi: 1) izpētīt Krimināllikuma 74.1 panta vēsturisko attīstību, 2) izpētīt Starptautisko regulējumu saistībā ar genocīda, noziegumu pret cilvēci, noziegumu pret mieru un kara noziegumu attaisnošanu, 3) veikt Krimināllikuma 74.1 panta dispozīcijā iekļautā noziedzīgā nodarījuma sastāva analīzi, 4) izpētīt un analizēt Krimināllikuma 74.1 panta pielietošanu praksē, 5) veikt ārvalstu regulējuma apskati un salīdzināt to ar Krimināllikuma 74.1 pantu, 6) rast priekšlikumus Krimināllikuma 74.1 panta uzlabojumam. The aim of the research is to conduct a general analysis of Article 74.1 of the Criminal Law of the Republic of Latvia in order to clarify the specifics of the development of the article since its inclusion in the Criminal Law in 2009, as well as to draw conclusions about the application of the article in practice. Tasks of the research: 1) to study the historical development of Article 74.1 of the Criminal Law, 2) to study the international regulations related to the justification of genocide, crimes against humanity, crimes against peace and war crimes, 3) to conduct an analysis of the composition of the criminal offense included in the provision of Article 74.1 of the Criminal Law, 4) to study and analyze the application of Article 74.1 of the Criminal Law in practice, 5) conduct a review of foreign regulation and compare it with Article 74.1 of the Criminal Law, 6) find proposals for the improvement of Article 74.1 of the Criminal Law.
