Mākslas objektu bojāšana politiska protesta ietvaros kā izteiksmes brīvības paušana Eiropā
Abstract
Bakalaura darba ietvaros darba autore analizēs robežu, ciktāl prettiesiskas darbības rezultātā bojāts mākslas objekts politiskā protestā varētu sasniegt demokrātiskas valsts iekārtas pamatmērķi – veicināt viedokļu un informācijas vispusīgu apmaiņu –, kā arī kritērijus un tendences šāda izteiksmes brīvības elementa ierobežošanai. Bakalaura darbā autore izvirzījusi šādus mērķus - analizēt aktuālākos Eiropas Cilvēktiesību tiesas judikatūrā piemērotos kritērijus izteiksmes brīvības ierobežošanā, kas varētu tikt piemēroti politiskas gribas paušanas darbībām, kā arī aplūkot un analizēt attiecīgo starptautisko un Latvijas Republikas tiesisko regulējumu un judikatūru, kas attiecas uz mākslas objektu aizsargāšanu pret indivīdu prettiesiskām darbībām. Bakalaura darba noslēgumā autore izvirza secinājumus par izteiksmes brīvības ierobežošanas problemātiku, izceļot konstatētās noregulēšanas priekšrocības un trūkumus. Within the framework of her bachelor thesis, the author will analyse the limit to which an art object damaged as a result of an unlawful act in political protest could achieve the fundamental purpose of the democratic state system - to promote a comprehensive exchange of opinions and information - as well as the criteria and tendencies for limiting such an element of freedom of expression. The author has set the following objectives in her bachelor thesis: to analyse the most relevant criteria in the case law of the European Court of Human Rights for restricting the freedom of expression that could be applied to acts of political expression of will, as well as to review and analyse the relevant international and Latvian legal framework and case law relating to the protection of art objects against unlawful acts of individuals. The author concludes the bachelor thesis by drawing conclusions on the problems of restricting freedom of expression, highlighting the advantages and disadvantages of the established regulation.
