Vecāku un vecvecāku uzturēšanas pienākums

Darba mērķis ir izpētīt vecāku un vecvecāku uzturēšanas pienākuma regulējumu Latvijā un ārvalstīs. Lai sasniegtu mērķi: 1.aplūkoti Latvijā esošie normatīvie akti, kuri regulē pienākumu uzturēt vecākus, vai vecvecākus institūtu; 2.veikts pilnīgs tiesu prakses apkopojums; 3.izstrādāta konkrēta shēma tiesu pieejai šādos strīdos; 4.izpētīts pienākuma uzturēt vecākus un vecvecākus vēsturiskais fons pasaulē; 5.izpētīts sociālās aprūpes pakalpojums Latvijā. Darbā tiek izvirzīti priekšlikumi, ņemot vērā citu valstu pieeju un Latvijas tiesu praksi, kas būtu efektīvāka un atvieglotu darbu gan tiesnešiem, gan personām, kas, iespējams, saskartos ar pienākumu uzturēt savus vecākus vai vecvecākus nākotnē. The purpose of the work is to study the regulation of the maintenance obligation of parents and grandparents in Latvia and abroad. In order to achieve the objective: 1. reviews the laws and regulations in Latvia governing the obligation to maintain parents or grandparents institute; 2. a complete summary of the case-law has been carried out; 3. a specific scheme for access to justice in such disputes has been developed; 4. explored the historical background of the obligation to maintain parents and grandparents in the world; 5. the social care service in Latvia has been investigated. Proposals are being put forward in the work, taking into account the approach of other countries and the case law of the courts of Latvia, which would be more effective and facilitate work for judges and persons who would potentially face the obligation to maintain their parents or grandparents in the future.
