Bakalaura darba temats ir “Taisnīguma elementi procesā par noziedzīgi iegūtu mantu”. Darba mērķis ir izpētīt vai tiesiskajā regulējumā nostiprinātā procesa par noziedzīgi iegūtu mantu norise ietver taisnīgas tiesas elementus. Process par noziedzīgi iegūtu mantu ir sevišķs process, kurš tiek vests paralēli standarta kriminālprocesam, lai vērtētu tikai mantiskos jautājumus par mantas izcelsmi un tālāko rīcību ar to. Šī procesa aktualitāte tikai pieaug, jo pēdējo gadu laikā tiesiskais regulējums vairākkārt ir mainījies, izdodot arvien jaunus Kriminālprocesa likuma grozījumus, pamatojoties uz Satversmes tiesas spriedumiem. Darba uzdevumi ir izpētīt procesu par noziedzīgi iegūtu mantu, analizēt procesa par noziedzīgi iegūtu mantu tiesisko regulējumu par pārsūdzības iespējām, piekļuvi materiāliem, iespēju pienācīgi sagatavoties tiesai, iesniegt pierādījumus, iepazīties ar Satversmes tiesas, Augstākās tiesas, Eiropas Savienības Tiesas un Eiropas Cilvēktiesību tiesas tiesu praksi, kā arī doktrīnu un periodiku, kas izveidojusies pēdējo gadu laikā sasaistot to ar tiesībām uz taisnīgu tiesu un saturu, kas no tām izriet. The topic of the bachelor thesis is "Elements of fairness in proceedings regarding criminally acquired property”. The aim of the thesis is to investigate whether the legal framework for proceedings for criminal property includes elements of a fair trial. Proceedings regarding criminally acquired property are a special procedure, which is carried alongside the standard criminal proceedings, to assess only the property issues of origin and further actions. The relevance of the proceeding regarding criminally acquired property is only increasing, as the legal framework has changed several times over the past years, with new amendments to the Criminal Procedure Law being issued on the basis of judgments of the Constitutional Court. The objectives of the thesis are to examine the concept of criminally acquired property, to analyse the legal framework of proceedings for criminal acquired property regarding the possibilities of appeal, access to materials, the opportunity to properly prepare for the trial, to submit evidence, to study the case law of the Constitutional Court, the Supreme Court, the Court of Justice of the European Union and the European Court of Human Rights, as well as the doctrine and publications that have developed in recent years in relation to the right to a fair trial and the content that arises from it.
