Noziedzīgajā nodarījumā par vainīgu atzītās personības raksturojums tiek atzīts par vienu no trim pamatkritērijiem piemērojot atbilstošu, samērīgu un invidualizētu sodu noziedzniekam. Likumdevējs nav konkrēti definējis vainīgās personības raksturojošās īpatnības un to ietekmi uz soda veidu un mēru, bet Krimināllikumā ir noteikts, ka vainīgā personība ietekmē abus šos sodu raksturojošos parametrus. Atkarībā no vainīgās personības izvērtējuma, tiesa var piemērot maigāku soda veidu nekā konkrētajā krimināllikuma sankcijā paredzēts vai tieši pretēji, izvēlēties bargāku soda veidu un mēru. Tiesai, lemjot par soda veidu ir jāmotivē soda veida izvēle atkarībā no vainīgās personības, veiktās noziedzīgās darbības radītā kaitējuma apmēra un rakstura. Šai bakalaura darbā tiek izskatīti tiesā izvērtētie vainīgās personības raksturojošie aspekti, kuri ietekmējuši piemērojamo soda veidu. Autore analizē soda invidualizācijas principa korelāciju ar vainīgā personības iezīmēm. The personality of the person found guilty of the commited crime is considered as one of the three basic criteria for imposing an appropriate, proportionate and individualised penalty. The legislator has not defined the characteristics of the guilty personality and their charasteristics impact on the type and level of punishment, but the Criminal Law in force in Latvia provides that the guilty personality influences both of these parameters describing punishment. On the basis of an assessment of the guilty person's personality, the court may impose a milder penalty than prescribed by the specific penalty of the criminal law or, on the contrary, choose a harsher penalty and measure. In determining the type of sentence, the court must motivate the choice of the type of sentence according to the personality of the perpetrator, the extent and nature of the harm caused by the criminal act committed. In this thesis, the aspects of the personality of the guilty person which have been assessed by the court and which have influenced the type of punishment to be applied are examined. The author analyses the correlation of the principle of invidualization of punishment with the personality traits of the perpetrator.
