Cilvēka cieņas koncepts no cilvēka tiesībām lemt par savu ķermeni aspekta

Maģistra darba mērķis ir noskaidrot vai personas tiesības lemt par savu ķermeni no cieņas konteksta ir absolūtas, kā arī noskaidrot kādas ir aktuālās juridiskās problēmas cilvēka tiesību lemt par savu ķermeni sakarā cilvēka cieņas kontekstā. Autore norāda, ka šī maģistra darba praktiskā nozīme ir juridiskas nozīmes piešķiršana cilvēka cieņas konceptam Latvijas tiesiskajā sistēmā un no cilvēka cieņas koncepta izrietošo cilvēka autonomijas jeb pašnoteikšanās par savu ķermeni aktuālo problēmjautājumu apzināšana. Darba ietvaros secināms, ka cilvēka cieņas koncepts vēl ir veidošanās stadijā, tomēr tiesību zinātnieki ir vienisprātis, ka cilvēka cieņu kā universālu vērtību ir pienākums aizsargāt ikvienai valstij. Pašnoteikšanās par savu ķermeni ir tieši izrietoša no cilvēka cieņas koncepta. Par spīti tam, ka cilvēka cieņa nav ierobežojama, no tās izrietošas tiesības pašnoteikties pār savu ķermeni ir ierobežojamas, ņemot vērā sabiedrības intereses. The aim of the master's thesis is to find out whether a person's right to decide about his or her body is restricted and what are the most topical issues regarding a person's right to decide about his or her body in the context of human dignity. The author points out that the practical significance of this master's thesis is the assignment of legal significance to the concept of human dignity in the Latvian legal system and to identify the current issues of human autonomy or self-determination arising from the concept of human dignity. It can be concluded that the concept of human dignity is still evolving, however, legal scholars agree that every country has a duty to protect human dignity as a universal value. Self-determination of one's body is a direct consequence of the concept of human dignity. Even though human dignity is not restricted, the resulting right to self-determination is restricted by the public interest.
