dc.description.abstract | Maģistra darba ietvaros tiek padziļināti pētīts katrs darba laika organizācijas veids, to saturs, piemērošanas priekšnoteikumi un nosacījumi, izzināti citu valstu normatīvie akti, doktrīnā paustais viedoklis un tiesu prakse, lai varētu apzināt, vai Latvijā ar esošo regulējumu darbinieks tiek pietiekami un taisnīgi aizsargāts ņemot vērā, ka joprojām tiek novēroti strīdi starp darba devēju un darbinieku par dažādiem darba laika organizācijas aspektiem. Darba mērķis ir izprast, kādos gadījumos darba devējam ir jāpiemēro konkrētais darba laika organizācijas veids un kādas ir biežākās kļūdas, kuras pieļauj darba devējs vai darbinieks, lai vērstu uz tām uzmanību un tās tiktu laicīgi novērstas, kā arī izpētīt likumu nepilnības un kāds regulējums būtu jāievieš vai jāatzīst par spēku zaudējušu. Darba rezultāti ļauj secināt, ka darba laika esošajā regulējumā ir daudz nepilnību un lietas, kas nonāk savstarpējās pretrunās. Tāpat ir nepieciešams veikt vairākus grozījumus Darba likumā, lai darba tiesiskās attiecības tiktu noregulētas vienlīdzīgi un taisnīgi pret visiem darbiniekiem. | |
dc.description.abstract | The Master's thesis examines in detail each type of working time organisation, their content, prerequisites and conditions of application. The laws, regulations, doctrines and case-law of other countries have been studied in order to determine whether the existing regulations in Latvia provide sufficient and fair protection for employees, considering that disputes between employers and employees on aspects of the organisation of working time are still being observed. The aim of the thesis is to understand when an employer should apply a particular type of working time organisation and what are the most common mistakes made by an employer or employee, so that attention can be drawn to them and they can be prevented in time. To investigate what is causing the legislative gaps and what regulation should be introduced or made no longer valid. The results of the thesis show that there are many shortcomings in the current working time framework and that there are many issues that conflict with each other. There is also a need for a number of amendments to the Labour Law in order to regulate labour relations in a way that is equal and fair to all employees. | |
